Introduction

This Construction Contract ("Contract") is entered into effective October 1, 2050, between [Your Name], hereinafter referred to as the "Owner," and Jacob Miller, hereinafter referred to as the "Contractor."

Scope of Work

The Contractor agrees to provide all labor, materials, equipment, and services necessary for the construction of residential homes located at 123 Maple Street, Springfield. The scope of work includes but is not limited to:

  • Site preparation and excavation

  • Foundation construction

  • Framing, roofing, and exterior finishing

  • Installation of plumbing, electrical, and HVAC systems

Price and Payment Terms

The total contract price for the project is $500,000, payable in installments as follows:

  • 20% of the total contract price upon signing this Contract as an initial deposit.

  • 50% progress payments based on completion milestones as mutually agreed upon by both parties.

  • Final 30% payment upon substantial completion of the project and acceptance by the Owner.

Contract Duration

The construction period shall commence on November 1, 2050, and shall be completed within 6 months from the commencement date, barring any delays due to unforeseen circumstances or changes in the scope of work.

Performance Standards

The Contractor shall adhere to industry best practices and standards in performing all aspects of the construction work. The quality of workmanship and materials used shall meet or exceed applicable building codes and regulations.

Responsibilities

  • The Owner shall provide access to the construction site and necessary permits.

  • The Contractor shall oversee all construction activities, coordinate subcontractors, and ensure compliance with the project schedule.

  • Both parties shall promptly communicate any issues or changes affecting the project's progress.

Subcontractors and Suppliers

The Contractor may engage subcontractors and suppliers as necessary to complete the project, provided that they meet the Owner's approval and adhere to the terms of this Contract.

Changes and Modifications

Any changes or modifications to the scope of work must be agreed upon in writing by both parties and may result in adjustments to the contract price and timeline.

Termination and Suspension

Either party may terminate this Contract with written notice in the event of a material breach by the other party. The Owner reserves the right to suspend work temporarily for reasons such as non-payment or failure to meet performance standards.

Insurance and Liability

The Contractor shall maintain adequate insurance coverage for the duration of the project, including but not limited to general liability, worker's compensation, and builder's risk insurance. The Owner shall not be liable for any injuries, damages, or losses arising from the Contractor's work, except in cases of negligence or willful misconduct.

Force Majeure

Neither party shall be held liable for any delays or failures in performance caused by circumstances beyond their reasonable control, including but not limited to acts of God, natural disasters, labor disputes, or governmental actions.

Governing Law and Jurisdiction

This Contract shall be governed by and construed under the laws of New York. Any disputes arising out of or relating to this Contract shall be resolved through arbitration in New York City, New York.

Miscellaneous Provisions

  • This Contract constitutes the entire agreement between the parties and supersedes any prior agreements or understandings, whether written or oral.

  • Any amendments or modifications to this Contract must be in writing and signed by both parties.

  • The headings used in this Contract are for convenience only and shall not affect its interpretation.
