WEDDING VIDEOGRAPHY CONTRACT

THIS AGREEMENT is made and entered into this Day of Month, Year by and between (Your Name), with the business address at (Your Company Address) (hereinafter referred to as the "Videographer") and (Client's Name), with a residential address at (Client's Address) (hereinafter referred to as the "Clients"), jointly referred to as the "Parties".

1. SCOPE OF THE SERVICES

The Videographer shall provide the Clients with the following professional services concerning the Clients' wedding occasion, scheduled to take place on (Wedding Date) at (Wedding Location):

  • Video Production

Pre-Event Planning:

- Collaborate with the Clients to determine specific video requirements, including style, format, and desired shots.

- Conduct site visits to the wedding venue to assess lighting conditions, acoustics, and potential filming locations.

- Develop a detailed shooting schedule and storyboard in consultation with the Clients to ensure all key moments are captured.

Filming:

- Provide professional

-grade video recording equipment, including cameras, lenses, microphones, and lighting, for high-quality footage.

- Capture various aspects of the wedding event, including but not limited to the ceremony, reception, speeches, and candid moments.

- Coordinate with other vendors photographers, and event planners to ensure seamless execution and minimal disruption to the event.

Post-Production:

- Edit raw footage to create a compelling narrative that highlights the emotional essence of the wedding day.

- Incorporate music, sound effects, and special effects as agreed upon with the Clients to enhance the overall cinematic experience.

- Provide draft versions of the video for review and feedback, allowing for revisions until the Clients are fully satisfied.

- Deliver the final edited video in the specified formats DVD, Blu-ray, and digital file within the agreed-upon timeline.

Deliverables:

- One (1) professionally edited wedding video capturing the essence of the event, approximately Duration 60 minutes, delivered in Format MP4, DVD.

- Optional add-ons such as highlight reels, extended cuts, or additional copies of the video are available upon request for an additional fee.

- Online hosting or streaming services for easy sharing with friends and family, if requested by the Clients.

Rights and Ownership:

- The Clients shall have full ownership rights to the final edited video for personal use, including sharing on social media platforms and making copies for friends and family.

- The Videographer reserves the right to use excerpts of the video for promotional purposes, with the Clients' consent.

2. COMPENSATION AND PAYMENT TERMS

The Clients agree to pay the Videographer a total fee of $3000. The payment schedule will be as follows:

2.1 Initial Deposit:

A non-refundable deposit of $1000 is due upon signing this agreement to secure the Videographer's services for the wedding date.

2.2 Interim Payment:

Interim Payment Percentage 50% of the total fee ($1500) is due one month before the wedding date.

2.3 Final Payment:

The remaining balance of $500 is due no later than one week before the wedding date.

2.4 Late Payment:

Any payments not received by the specified due dates shall be subject to a late fee of Late Fee Percentage 10% of the overdue amount, compounded monthly.

2.5 Method of Payment:

Payments shall be made via bank transfer in the name of the Videographer as provided in the invoice.

2.6 Taxes and Additional Expenses:

  • All applicable taxes, including sales tax, shall be included in the total fee.

  • Any additional expenses incurred by the Videographer, such as travel or accommodation costs, shall be reimbursed by the Clients in full within the Reimbursement time frame of 14 days of receipt of the Videographer's invoice.

3. CANCELLATION POLICY

In the event of a cancellation, the Clients shall notify the Videographer immediately. Cancellation fees may apply at the discretion of the Videographer.

3.1 Cancellation Fees:

  • If the Clients cancel the contract Cancellation Notice Period is less than 30 days before the scheduled wedding date, and the Clients shall forfeit the initial deposit as a cancellation fee.

  • If the Clients cancel the contract Second Cancellation Notice Period less than 14 days before the scheduled wedding date, the Clients shall forfeit Percentage of Total Fee 50% of the total fee as a cancellation fee.

  • If the Clients cancel the contract Third Cancellation Notice Period less than 7 days before the scheduled wedding date, the Clients shall forfeit the full total fee as a cancellation fee.

3.2 Force Majeure:

  • In the event of circumstances beyond the control of either party (e.g., natural disasters, acts of terrorism, pandemic-related restrictions) leading to the cancellation or postponement of the wedding event, both parties agree to negotiate in good faith to reschedule the Videographer's services without penalty.

3.3 Refund Policy:

  • In the event of cancellation by the Clients, any refunds or partial refunds of fees paid shall be at the sole discretion of the Videographer.

  • No refunds shall be provided for services already rendered or expenses incurred by the Videographer in preparation for the wedding event.

3.4 Notice of Cancellation:

  • Cancellation notices must be provided in writing and sent to the contact information provided by the Videographer in this agreement.

4. COPYRIGHT AND USAGE RIGHTS

The Videographer shall retain the copyright of the video footage while granting the Clients the rights to use and distribute the footage for personal, non-commercial purposes.

4.1 Copyright Ownership:

The Videographer shall retain all rights, title, and interest, including copyright, in and to the video footage captured during the wedding event.

4.2 Usage Rights Granted to Clients:

The Clients are granted a non-exclusive, non-transferable license to use and distribute the video footage solely for personal, non-commercial purposes, including but not limited to sharing with friends and family, posting on social media platforms, and creating personal copies.

4.3 Commercial Use Prohibited:

The Clients shall not use the video footage for any commercial purposes, including but not limited to advertising, promotion, or resale, without the express written consent of the Videographer.

4.4 Alterations and Modifications:

The Clients shall not alter, modify, or edit the video footage in any way without the prior written consent of the Videographer.

4.5 Attribution:

Whenever the Clients publicly display or distribute the video footage, they shall provide appropriate attribution to the Videographer, acknowledging the Videographer's copyright ownership.

4.6 Promotional Use by Videographer:

The Videographer reserves the right to use excerpts of the video footage for promotional purposes, including but not limited to showcasing in portfolios, websites, and social media channels, with the Clients' consent.

4.7 Transferability:

The Clients shall not transfer or sublicense their usage rights to any third party without the prior written consent of the Videographer.

5. INDEMNIFICATION AND LIABILITY

The Parties agree to indemnify and hold harmless each other from and against all damages, losses, and expenses, including reasonable attorney's fees and costs, related to all third-party claims, charges, and investigations.

5.1 Indemnification by Clients:

The Clients agree to indemnify and hold harmless the Videographer from and against any claims, demands, liabilities, damages, losses, costs, and expenses, including reasonable attorney's fees, arising out of or in connection with any breach of this agreement by the Clients or their guests, or any third-party claims related to the video production services provided by the Videographer.

5.2 Indemnification by Videographer:

The Videographer agrees to indemnify and hold harmless the Clients from and against any claims, demands, liabilities, damages, losses, costs, and expenses, including reasonable attorney's fees, arising out of or in connection with any breach of this agreement by the Videographer or their personnel, or any third-party claims related to copyright infringement or unauthorized use of third-party materials in the video footage.

5.3 Notification:

In the event of any claim or legal action covered by this indemnification clause, the indemnified party shall promptly notify the indemnifying party in writing of such claim or action and provide all necessary cooperation, information, and assistance in the defense or settlement thereof.

5.4 Limitation of Liability:

Except for instances of gross negligence or willful misconduct, the total liability of each party under this agreement shall not exceed the total fees paid by the Clients to the Videographer under this agreement.

5.5 Survival:

The indemnification and liability provisions of this agreement shall survive the termination or expiration of this agreement.

6. GOVERNING LAW

This Agreement shall be governed by and construed by the laws of (State/Country).
