Cake Contract

THIS CONTRACT is made effective this [Date], by and between [Baker's Name] (hereinafter referred to as "Baker") with a mailing address at [Baker's Address] and [Client's Name] (hereinafter referred to as "Client") with a mailing address at [Client's Address].

1. Cake Details

The Baker agrees to create a custom cake for the Client's event as follows:

1.1 Design:

The cake design will feature a three-tiered arrangement adorned with intricate floral decorations in shades of pink, lavender, and cream. The theme will be a rustic-chic style with burlap accents and delicate sugar flowers cascading down the tiers. The top tier will include a custom monogram of the client's initials.

1.2 Flavor(s):

The cake will consist of alternating layers of moist vanilla sponge infused with Madagascar vanilla bean extract and luscious chocolate fudge cake filled with layers of raspberry preserve and whipped ganache.

1.3 Size: The cake dimensions will be as follows:

  • Tier 1: 8 inches in diameter, serving approximately 20 guests

  • Tier 2: 10 inches in diameter, serving approximately 30 guests

  • Tier 3: 12 inches in diameter, serving approximately 50 guests

2. Delivery/Pickup Instructions

The cake will be delivered by the Client on [Date], at the wedding reception held at "The Garden Venue,". Delivery will be made between 2:00 PM and 3:00 PM. The Client agrees to provide accurate delivery information, including contact details and any specific instructions, to ensure the timely receipt of the cake.

3. Payment Terms

The total cost of the cake is $500. A non-refundable deposit of $200 is required to secure the order, payable upon signing this Contract. The remaining balance of $300 is due no later than May 31, 2024. Payments can be made via cash, check, or credit card.

4. Changes and Revisions

Alterations or amendments to the cake order should be presented in written form at least 14 days before the event date. The Baker has the authority to modify the final price and delivery date depending on the proposed changes.

5. Liability Waivers

It is explicitly stated that the Baker, will not bear any form of accountability or liability for any unfortunate incidents that may arise, be it damages, accidents, or injuries, as a result of the consumption or application of the cake once it has been delivered or picked up by the client. All risks and responsibilities attached to ensuring that the handling and storage of the cake is conducted safely and securely fall entirely to the client. The client fully acknowledges this arrangement and will not hold Baker accountable in any way.

6. Cancellation Policy

If the client decides to cancel their reservation or booking arrangement, they should be aware that their deposited amount will not be refunded under any circumstances. Moreover, if such a cancellation is made with less than a month's notice from the date of the scheduled event, the client will lose the entire amount that they have paid. In other words, the full payment will be forfeited in the case of any cancellations occurring less than 30 days before the event date.

7. Governing Law

This Contract shall be governed by, presided over, and interpreted by the existing legal statutes, rules, and regulations that have been put in place within the jurisdiction of [Your Jurisdiction].
