This contract ("Contract") is entered into on [Date], between [Client's Name] ("Clients") and [YOUR NAME] ("Baker") for the provision of wedding cake services. This Contract outlines the terms and conditions governing the creation, delivery, and payment of the wedding cake.
The Clients agree to provide detailed specifications regarding the design, size, shape, colors, and decorations of the wedding cake. Any changes to the design must be communicated to the Baker no later than [Agreed Upon Date] before the wedding date.
The Clients will select flavors for each tier of the wedding cake from Baker's available options. Any special requests for flavors must be communicated to the Baker in advance.
The Baker will deliver the wedding cake to the designated venue at the agreed-upon date and time. The Clients must provide accurate delivery information, including the venue address and contact person.
The Clients or their designated representative must be present at the venue to receive the cake upon delivery. The Clients acknowledge that once the cake is delivered and set up according to the agreed design, the Baker shall not be liable for any damage to the cake thereafter.
If the Clients or their representatives are not available to receive the cake at the agreed-upon time, the Baker reserves the right to charge an additional fee for redelivery or wait time.
The total cost of the wedding cake, including any additional fees for delivery, setup, or customization, is $800. This amount shall be outlined clearly in the invoice provided by the Baker.
To secure the booking, a non-refundable deposit of $200 is required. The deposit is due upon signing this Contract. Failure to provide the deposit may result in the cancellation of the booking by the Baker.
Payments for the wedding cake services can be made via cash, check, or credit card. The Baker shall specify the accepted methods of payment. Late payments may incur additional charges as outlined in Section 4 (Cancellation Policy).
Should the Clients decide to cancel, the monetary deposit they have already provided will not be returned or refunded to them.
Cancellations made less than 14 days before the wedding date will result in the Clients being responsible for the full payment of the agreed-upon amount. In the event of a late cancellation, the Clients acknowledge and agree to compensate the Baker for any costs incurred, including materials purchased and labor invested in preparing the wedding cake.
The Baker reserves the right to cancel the Contract in the event of unforeseen circumstances such as illness, injury, or any other legitimate reason. In such cases, all payments made by the Clients will be refunded in full.
Neither party shall be liable for any failure or delay in performing their obligations under this Contract due to circumstances beyond their reasonable control, including but not limited to acts of God, natural disasters, war, or government regulations.
This Contract shall be governed by and construed by the laws of [Jurisdiction]. Any disputes arising out of or in connection with this Contract shall be resolved through amicable negotiation between the parties. If a resolution cannot be reached, the parties agree to submit to the exclusive jurisdiction of the courts of [Jurisdiction].
