Rental Agreement
This Roommate Rental Agreement (hereinafter referred to as the "Agreement") is made and entered into this [Date], by and among [Primary Tenant's Full Name] (hereinafter referred to as the "Primary Tenant"), residing at [Primary Tenant's Current Address], and [Roommate's Full Name(s)] (hereinafter referred to as the "Roommate(s)"), collectively referred to as the "Parties," with regard to the premises located at [Complete Property Address] (hereinafter referred to as the "Premises").
WHEREAS, the Primary Tenant is the leaseholder of the Premises, having entered into a lease agreement with the Landlord, [Your Company Name], on [Lease Agreement Date]; and
WHEREAS, the Primary Tenant desires to share the Premises with the Roommate(s), and the Roommate(s) desire to share the Premises with the Primary Tenant under the terms and conditions set forth herein;
NOW, THEREFORE, in consideration of the mutual promises and agreements contained in this Agreement, and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the Parties agree as follows:
I. Term of Agreement
This Agreement shall commence on [Date], and shall continue on a month-to-month basis. Either party may terminate this Agreement with a 30-day written notice to the other parties.
II. Rent and Utilities
A. Monthly Rent: The total monthly rent for the Premises is $2,000. The Roommate(s) shall pay the Primary Tenant their share of the rent, which is $1,000, due on the first day of each month.
B. Late Rent: Rent payments made after the fifth day of the month will incur a late fee of $50. Continuous failure to pay rent within 10 days of the due date may result in termination of this Agreement by the Primary Tenant.
C. Utilities and Services: The Roommate(s) shall share equally in the costs of utilities and services, including electricity, water, gas, and internet. Each Roommate's share is estimated to be $100 per month, subject to actual billing.
D. Payment of Utilities: Utility payments are due by the 15th of each month. The Primary Tenant shall provide the Roommate(s) with copies of utility bills. If payment is not made within 5 days after the due date, a late fee of $25 shall be applied.
III. Security Deposit
A. Amount: The Roommate(s) shall pay the Primary Tenant a security deposit of $500 upon execution of this Agreement. This deposit shall serve as security for any damages caused by the Roommate(s) to the Premises or for any unpaid rent or utilities.
B. Conditions for Return: The security deposit will be returned to the Roommate(s) within 30 days of the termination of this Agreement, less any deductions for damages, unpaid rent, or unpaid utilities. The Primary Tenant shall provide an itemized statement of deductions, if any.
C. Deductions: Deductions from the security deposit will be made for damages to the Premises beyond normal wear and tear, unpaid rent, and unpaid utilities. The Primary Tenant agrees to provide receipts or estimates for any repairs or cleaning costs deducted from the security deposit.
IV. Living Arrangements
A. Private and Common Areas: The Premises consist of two bedrooms, one bathroom, a living room, a kitchen, and a dining area. Each Roommate shall have exclusive use of their own bedroom. The bathroom, living room, kitchen, and dining area shall be considered common areas and shared equally by all roommates.
B. Household Duties: All Roommates agree to share equally in household duties, including cleaning common areas, disposing of trash, and maintaining the cleanliness and orderliness of the Premises. A cleaning schedule shall be established and agreed upon within the first week of occupancy.
V. Rules and Regulations
A. Guest Policy: Roommates may have guests over but must respect the rights and privacy of other roommates. Overnight guests are allowed for a maximum of 3 consecutive nights and no more than 6 nights in any given month, unless agreed upon by all roommates in writing.
B. Noise and Quiet Hours: To ensure a peaceful living environment, quiet hours will be observed from 10 PM to 7 AM on weekdays and from midnight to 8 AM on weekends. During quiet hours, noise levels should be kept to a minimum to not disturb other roommates or neighbors.
C. Pet Policy: No pets are allowed on the Premises without the prior written consent of all roommates and the Landlord. If approved, the Roommate owning the pet shall pay an additional pet deposit of $250, which is refundable at the end of the tenancy provided there are no pet-related damages.
D. Smoking Policy: Smoking is not permitted inside the Premises at any time. Designated smoking areas may be established outside the Premises if agreed upon by all roommates.
E. Alcohol and Drugs: The use of illegal drugs on the Premises is strictly prohibited. Alcohol may be consumed responsibly by roommates of legal drinking age.
F. Responsibility for Damages: Roommates are individually responsible for any damages they cause to the Premises or for any damages caused by their guests. Payment for repairs or replacements must be made within 30 days of the damage occurrence.
VI. Termination and Vacate Rules
A. Notice of Termination by Roommate: A Roommate wishing to terminate this Agreement must provide the Primary Tenant and remaining Roommates with a written notice of at least 30 days before the intended vacate date.
B. Termination by Primary Tenant: The Primary Tenant may terminate this Agreement with a Roommate if the Roommate fails to comply with the terms of this Agreement, including but not limited to, failure to pay rent or utilities, or violation of the Rules and Regulations. In such cases, the Primary Tenant will provide a 15-day written notice to the Roommate to correct the violation, followed by a 30-day notice of termination if the violation is not corrected.
C. Move-Out Procedures: Upon termination, the vacating Roommate must return all keys to the Primary Tenant, remove all personal property, and leave their room and common areas in clean condition. An inspection of the Premises will be conducted by the Primary Tenant and remaining Roommates to assess any damages beyond normal wear and tear.
VII. Dispute Resolution
A. Negotiation: Roommates agree to attempt to resolve any disputes arising from or related to this Agreement through direct, good-faith negotiation.
B. Mediation: If negotiation fails, Roommates agree to engage in mediation before pursuing any further legal action. Each Roommate will bear their own costs of mediation.
C. Arbitration: As a last resort, disputes that cannot be resolved through negotiation or mediation may be settled by arbitration in accordance with the rules of the American Arbitration Association, with the decision of the arbitrator being final and binding upon the parties.
VIII. Landlord's Rights and Obligations
A. Consent for Roommate Arrangement: The Primary Tenant confirms that they have obtained the Landlord's consent for this Roommate arrangement, as required by the original lease agreement with the Landlord.
B. Landlord's Access to Premises: All Roommates acknowledge that the Landlord retains the right to access the Premises as outlined in the Primary Tenant's lease agreement, including for inspections, repairs, and emergencies.
C. No Alteration of Landlord's Obligations: This Agreement does not alter or diminish any of the Landlord's obligations under the lease agreement with the Primary Tenant, including maintenance and repairs of the Premises.
