Lease Agreement
This Temporary Lease Agreement (hereinafter referred to as the "Agreement") is made and entered into this [Date], by and between [Your Company Name], (hereinafter referred to as the "Landlord"), with a mailing address of [Your Company Address], and [Tenant Name], (hereinafter referred to as the "Tenant"), with a mailing address of [Tenant Address].
WHEREAS, the Landlord is the lawful owner of the property located at [Property Address], including all amenities and appurtenances thereto (hereinafter referred to as the "Property");
AND WHEREAS, the Tenant desires to temporarily lease the Property from the Landlord, and the Landlord agrees to lease the Property to the Tenant on a temporary basis under the terms and conditions set forth herein;
NOW, THEREFORE, in consideration of the mutual covenants and agreements contained in this Agreement, and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties hereto agree as follows:
I. Term of Lease
This Agreement shall commence on [Start Date], and shall terminate on [End Date], for a total term of 6 months.
II. Rent Details
A. Total Rent for Term: The total rent for the duration of the lease term shall be $6,000, payable in monthly installments of $1,000 each.
B. Payment Schedule: Rent is due on the first day of each month, beginning [Start Date]. The first and last month's rent shall be paid upfront as a security measure.
C. Late Payment: Rent payments received after the fifth day of the month will incur a late fee of $50.
D. Security Deposit: A security deposit of $1,000 is required at the time of signing this Agreement. It will be returned within 30 days of the lease termination, less any deductions for damage beyond normal wear and tear.
III. Property Description
A. Location and Layout: The Property is located at [Property Address] and consists of a furnished studio apartment approximately 500 square feet in size, including a bathroom and kitchenette.
B. Furnishings and Appliances: The Property is furnished with a bed, sofa, dining table with two chairs, a refrigerator, and a microwave. A detailed inventory list is attached as Appendix A to this Agreement.
IV. Use of Property
A. Residential Use: The Property is to be used exclusively for residential purposes by the Tenant. No commercial activities are permitted without the Landlord's prior written consent.
B. Occupancy: Occupancy is limited to Tenant only. Overnight guests are permitted for a maximum of 7 consecutive nights and no more than 14 nights in total during the lease term.
C. Pets: No pets are allowed on the Property without the Landlord's prior written consent. If consent is granted, an additional pet deposit may be required.
D. Smoking: Smoking is strictly prohibited inside the Property. Violation of this policy may result in immediate termination of the lease.
V. Maintenance and Repairs
A. Tenant's Responsibilities: The Tenant agrees to maintain the interior of the Property in a clean and sanitary condition, promptly reporting any need for repairs or maintenance to the Landlord.
B. Landlord's Responsibilities: The Landlord shall be responsible for all major repairs and maintenance of the Property's structural elements, plumbing, electrical systems, and appliances provided by the Landlord.
VI. Utilities and Services
A. Included Utilities: Utilities included in the rent are water, electricity, and gas. The Tenant shall not be responsible for payment of these services.
B. Additional Services: Any other utilities or services, such as internet and cable television, are the responsibility of the Tenant.
VII. Termination
A. Notice Requirement: Either party may terminate this Agreement with a written notice of 30 days before the lease end date.
B. Early Termination: In the event of early termination by the Tenant, the Tenant agrees to pay a termination fee equivalent to one month's rent.
VIII. House Rules
A. Noise: Tenants agree to keep noise levels to a minimum between 10 PM and 7 AM to respect the peace and quiet of neighbors.
B. Visitors: Overnight visitors are limited as specified in Section IV-B. Parties and large gatherings are not permitted without the Landlord's prior consent.
C. Parking: If applicable, parking is limited to one vehicle per Tenant and must be in designated areas only.
IX. Legal Clauses
A. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the state where the Property is located.
B. Dispute Resolution: Any disputes arising from this Agreement shall first be attempted to be resolved through direct negotiation. If unresolved, mediation or arbitration may be sought before any legal action.
C. Amendment: Any amendments to this Agreement must be in writing and signed by both parties.
D. Entire Agreement: This Agreement constitutes the entire agreement between the parties and supersedes all prior discussions, agreements, or understandings.
