This Real Estate Short-Term Rental Agreement (hereinafter referred to as the "Agreement") is made and entered into on this [Month Day, Year], by and between [Your Company Name], with its principal place of business located at [Your Company Address] and contactable via [Your Company Email], [Your Company Number], herein referred to as the “Owner,” and [Tenant Name], with contact information [Tenant Email], [Tenant Number], herein referred to as the “Tenant.”
1. PROPERTY
The Owner hereby agrees to rent to the Tenant the premises situated at [Property Address], hereinafter referred to as the “Property,” including all furnishings, appliances, and personal property provided by the Owner (collectively, the "Personal Property") located thereon. This Property is to be occupied and used strictly for residential purposes and not for any commercial activity.
2. TERM
The lease term under this Agreement shall commence on [Start Date] and shall terminate on [End Date], with no automatic renewal provision. Any extension of this term shall be subject to a separate written agreement between the Owner and Tenant.
3. RENT

5. USE OF PROPERTY

The Tenant is obligated to ensure that their conduct and the conduct of anyone present on the Property does not disturb the peace or safety of the neighbors or constitute a nuisance in any manner.

Activities that violate local zoning ordinances or that may cause excessive wear or damage to the Property are strictly prohibited.

The Tenant shall not sublet the Property or any part thereof, or assign this Agreement, without the Owner's prior written consent.

The Tenant shall also adhere to any reasonable rules or regulations posted by the Owner regarding the use and care of the Property.
6. REPAIR AND MAINTENANCE

The Tenant is responsible for maintaining the Property, including all personal property provided by the Owner, in a clean, safe, and sanitary condition, taking into account normal wear and tear.

The Tenant shall promptly notify the Owner in writing of any damages, defects, or the need for repairs, after which the Owner shall have a reasonable period to undertake necessary repairs.

The Tenant shall not make any alterations, improvements, or additions to the Property without the Owner's prior written consent.

At the termination of this Agreement, the Tenant agrees to return the Property in the same condition as at the beginning of the term, except for normal wear and tear.

The Tenant is responsible for the conduct and any damage caused by all persons occupying or visiting the Property.
7. INSURANCE

The Tenant agrees to secure and maintain a renter’s insurance policy that provides adequate coverage for personal property within the Property against damage or loss due to theft, fire, vandalism, and other risks.

The Tenant shall furnish the Owner with proof of such insurance upon request. The policy should also include liability coverage to protect against potential claims arising from accidents or injuries occurring within the Property.

The Owner shall maintain insurance covering structural damages to the Property itself.

The Tenant's failure to obtain or maintain such renter’s insurance as required herein may constitute a breach of this Agreement.
8. DEFAULT AND REMEDIES

In the event of the Tenant's failure to comply with any of the essential terms of this Agreement, including but not limited to, timely payment of rent and adherence to property use provisions, the Owner shall provide the Tenant with written notice of such default.

Should the Tenant fail to remedy the default within the period stipulated in the notice, the Owner reserves the right to terminate this Agreement.

Upon termination, the Owner may repossess the Property and seek any legal remedies available, including but not limited to, damages for unpaid rent, costs for repair of damages to the Property beyond normal wear and tear, and reasonable legal fees incurred.

The Owner's failure to enforce any term of this Agreement shall not be deemed a waiver of the right to enforce such term or any other term of this Agreement in the future.
9. GOVERNING LAW AND DISPUTE RESOLUTION

This Agreement shall be governed by and construed in accordance with the laws of the State of [State].

Any disputes arising out of or related to this Agreement shall be resolved through mediation, and if unsuccessful, then by arbitration in accordance with the rules of the American Arbitration Association.
