These bylaws cover permits, safety standards, water quality, noise, and enforcement. They uphold the highest standards of safety and cleanliness. It's the responsibility of all involved to understand and follow these bylaws, creating a community where pools are enjoyed safely by all.
Any structure, basin, or vessel, whether above ground or below ground, intended for swimming, wading, diving, recreational bathing, or therapeutic purposes.
Any person, group, corporation, or entity holding legal title to a property with a swimming pool or having control or custody of such property.
Any individual or entity is responsible for the day-to-day operation and maintenance of a swimming pool.
The City of Brampton municipal government.
No person shall commence the construction or installation of a swimming pool within the City of Brampton without first obtaining a valid permit from the municipality.
Before the use of a swimming pool, the owner or operator must obtain an annual operation permit from the municipality, demonstrating compliance with all relevant safety and health regulations.
All swimming pools must be enclosed by a fence or barrier of sufficient height and durability to prevent unauthorized access by children and animals. Such enclosures must comply with the Ontario Building Code.
Adequate safety equipment, including but not limited to life rings, life hooks, and first aid kits, must be readily accessible at all times within the pool area.
A responsible adult must supervise all swimming pool activities, particularly in the case of children or inexperienced swimmers.
The owner or operator of a swimming pool is responsible for maintaining water quality following provincial health standards. Regular testing and treatment of pool water must be conducted to prevent the spread of disease and ensure user safety.
Swimming pools must be regularly cleaned to prevent the buildup of algae, bacteria, and other contaminants. Debris such as leaves, insects, and litter must be promptly removed from the pool and surrounding area.
The structural integrity of swimming pool components, including walls, floors, and drains, must be regularly inspected and maintained to prevent accidents or injuries.
Owners and operators of swimming pools must take reasonable measures to minimize noise disturbances to neighboring properties, particularly during nighttime hours.
Outdoor lighting associated with swimming pools must be directed and shielded to prevent glare and light pollution from affecting adjacent properties.
Authorized representatives of the municipality may conduct periodic inspections of swimming pools to ensure compliance with these bylaws.
Violation of any provision of these bylaws may result in penalties, fines, or other enforcement actions as determined by the municipality. Repeat offenses may result in the suspension or revocation of permits.
Should any section, clause, or provision of these bylaws be deemed invalid or unenforceable, it shall not affect the validity or enforceability of the remaining provisions.
These bylaws shall come into force and effect on the date of passage by the City Council of Brampton.
