This bylaw shall be known as the "City of Greater Sudbury Building and Development Regulation Bylaw."
"Building Codes": Refers to the set of regulations and standards established by the Ontario Building Code Act.
"Zoning Regulations": Pertains to the regulations outlined in the City of Greater Sudbury Zoning Bylaw, governing land use and development within the municipality.
"Permit": Authorization granted by the municipality to commence specified construction or development activities.
The purpose of this bylaw is to regulate building and development activities within the City of Greater Sudbury, ensuring compliance with zoning regulations and building codes.
It is intended to promote safe, sustainable, and harmonious development while protecting the health, safety, and welfare of residents.
No person shall undertake any construction, alteration, or demolition of any building or structure within the City of Greater Sudbury without obtaining the necessary permits as required by this bylaw.
Permit applications shall be submitted to the City's Building Department and shall include detailed plans and specifications, along with any other information deemed necessary by the Chief Building Official.
The Chief Building Official shall review permit applications to ensure compliance with zoning regulations, building codes, and other applicable laws. Upon satisfactory review, permits shall be issued subject to any conditions deemed necessary.
Before issuing any building permit, the Chief Building Official shall verify that the proposed construction or development complies with the zoning regulations outlined in the City of Greater Sudbury Zoning Bylaw.
Any proposed development that does not conform to the zoning regulations may require variances or amendments to the zoning bylaw, subject to approval by the City's Committee of Adjustment or City Council.
The Chief Building Official or their designated inspectors shall conduct inspections of construction sites to ensure compliance with permit conditions, building codes, and zoning regulations.
Non-compliance with this bylaw may result in enforcement actions, including stop-work orders, fines, and legal proceedings, as deemed necessary by the City.
Any person aggrieved by a decision of the Chief Building Official or any enforcement action taken under this bylaw may appeal to the Ontario Municipal Board (OMB) by the provisions of the Ontario Building Code Act and other applicable legislation.
Any person who contravenes any provision of this bylaw shall be guilty of an offense and, upon conviction, shall be liable to penalties as prescribed by the Provincial Offenses Act.
If any provision of this bylaw is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the bylaw, and the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.
This bylaw shall come into force and take effect on [effective date].
The City of Greater Sudbury Building and Development Regulation Bylaw [previous bylaw number if applicable] is hereby repealed and replaced by this bylaw.
