Chapter 1: General Provisions

1.1: Title

These regulations shall be known and may be cited as the City of Calgary Bylaws.

1.2: Purpose

The purpose of these Bylaws is to regulate various aspects of public life within the City of Calgary, including but not limited to zoning, noise control, property maintenance, business regulations, and other matters affecting the welfare and well-being of its residents.

Chapter 2: Zoning Regulations

2.1: Zoning Districts

The City of Calgary shall be divided into distinct zoning districts, each with specific regulations governing land use, density, building height, setbacks, and other relevant factors. Zoning maps and regulations shall be maintained and updated by the Planning Department and made available to the public.

2.2: Land Use Permissions

Landowners and developers must obtain appropriate permits and approvals from the City Planning Department before undertaking any development or land use activity within designated zoning districts. Failure to comply with zoning regulations may result in fines, penalties, or cessation of activities.

Chapter 3: Noise Control

3.1: Noise Regulations

It shall be unlawful for any person, business, or entity to generate excessive noise that disturbs the peace of residential neighborhoods or interferes with the enjoyment of public spaces. Noise levels shall be regulated based on time of day and location, with stricter regulations in place during nighttime hours.

3.2: Permissible Activities

Certain activities, such as construction, transportation, and public events, may be exempt from noise regulations under specific conditions and with prior approval from the City Noise Control Commission. Adequate measures must be taken to minimize noise disturbances and protect the quality of life for residents.

Chapter 4: Property Maintenance

4.1: Minimum Standards

All property owners within the City of Calgary are responsible for maintaining their premises in a safe, clean, and sanitary condition. This includes but is not limited to proper waste disposal, upkeep of landscaping, removal of graffiti, and maintenance of structural integrity.

4.2: Inspections and Enforcement

The City Building and Property Maintenance Department shall conduct regular inspections to ensure compliance with property maintenance standards. Violations shall be subject to fines, corrective action orders, or legal proceedings as deemed necessary by the enforcing authorities.

Chapter 5: Business Regulations

5.1: Licensing and Permits

Businesses operating within the City of Calgary must obtain appropriate licenses and permits from the Business Licensing Department. This includes but is not limited to commercial activities, food establishments, entertainment venues, and home-based businesses.

5.2: Health and Safety Standards

Business owners are required to adhere to all applicable health and safety regulations to protect the well-being of employees, customers, and the public. Failure to comply may result in fines, closure orders, or revocation of business licenses.

Chapter 6: Enforcement and Penalties

6.1: Enforcement Authority

The City of Calgary Bylaws shall be enforced by designated municipal officers, law enforcement personnel, and other authorized agents. These officials are empowered to issue warnings, citations, and fines, and undertake necessary actions to ensure compliance with regulations.

6.2: Penalties

Violations of the City of Calgary Bylaws may result in monetary fines, penalties, or legal action as prescribed by the Municipal Court. Repeat offenders or serious violations may be subject to escalated penalties, including cessation of activities or imprisonment.

Chapter 7: Amendments and Revisions

7.1: Amendment Procedures

These Bylaws may be amended or revised through the formal process of City Council resolution, public hearings, and consultation with relevant stakeholders. Proposed changes shall be published and made available for public review prior to adoption.

7.2: Effective Date

These Bylaws shall take effect upon adoption by the City Council and shall supersede any previous regulations or ordinances inconsistent herewith. All residents, businesses, and entities within the City of Calgary are hereby notified of their obligations and responsibilities under these Bylaws.

7.3: Severability

If any provision of these Bylaws is held to be invalid or unenforceable by a court of competent jurisdiction, such invalidity or unenforceability shall not affect the validity or enforceability of the remaining provisions herein.

Chapter 8: Definitions

8.1: Definitions

For the purposes of these Bylaws, the following terms shall have the meanings ascribed to them: a. "City" means the City of Calgary. b. "Person" includes individuals, corporations, partnerships, associations, and other legal entities. c. "Public space" means any area owned or controlled by the City and accessible to the general public. d. "Residential neighborhood" means an area primarily zoned for single-family or multi-family dwellings. e. "Zoning district" means a designated area within the City with specific land use regulations.

8.2: Interpretation

In the interpretation of these Bylaws, the singular shall include the plural, the plural shall include the singular, and the masculine shall include the feminine and vice versa, as the context may require.

Chapter 9: Repeal

9.1: Repeal of Previous Bylaws

All previous Bylaws, ordinances, or regulations inconsistent with these provisions are hereby repealed to the extent of such inconsistency.

9.2: Savings Clause

Any rights, obligations, or legal proceedings existing under prior Bylaws shall remain unaffected by the repeal herein, unless expressly provided otherwise.
