This Nursing Home Service Contract (hereinafter referred to as the “Contract”) is made effective as of [Date], by and between [Your Company Name] (hereinafter referred to as the “Facility”), a duly licensed entity under the laws of [State/Country], with its principal place of business located at [Your Company Address], and [Resident Name], (hereinafter referred to as the “Resident”), an individual seeking residence and care at the Facility, and/or [Legal Representative Name], the legal representative of the Resident (hereinafter referred to as the “Legal Representative”).

Whereas, the Facility is engaged in providing nursing home services, including but not limited to lodging, healthcare, and personal care services for seniors and individuals requiring specialized care; and

Whereas, the Resident desires to avail themselves of such services provided by the Facility and agrees to the terms and conditions set forth herein;

Now, therefore, in consideration of the mutual covenants and agreements contained in this Contract, the parties agree as follows:

1. Services Provided

The Facility shall provide the following services to the Resident:

1.1. Accommodation: Furnishing of a private or semi-private room equipped with essential furniture, emergency call systems, and accessibility features as per the Resident’s needs.

1.2. Basic Healthcare and Nursing Services: Provision of routine healthcare and nursing services, including but not limited to medication management, assistance with daily living activities (ADLs), and monitoring of health status by licensed nurses.

1.3. Meals and Dietary Services: Three nutritious meals per day, tailored to meet the dietary needs and preferences of the Resident, along with scheduled snacks and hydration programs.

1.4. Housekeeping and Laundry: The Resident's room will be provided with regular housekeeping services. This includes the maintenance and upkeep of their living space to ensure cleanliness and orderliness. Additionally, personal laundry services will also be offered. However, it should be noted that these laundry services do not cover the provision of dry cleaning services.

1.5. Social and Recreational Activities: Access to a variety of social, educational, and recreational activities designed to promote the Resident’s physical, mental, and social well-being.

1.6. Transportation: The service that is arranged and provided according to a set schedule is specifically designed to cater to the needs of those who need transportation for attending medical appointments and participating in group outings.

1.7. Specialized Care Services: As needed, the Facility will provide or arrange for the provision of physical therapy, occupational therapy, speech therapy, and other specialized healthcare services, which may incur additional costs.

2. Fees and Payment Terms

2.1. Monthly Fee: The Resident agrees to pay a monthly fee of [Amount], which covers the cost of services listed in Section 1. This fee is subject to annual review and adjustment.

2.2. Additional Services: Services not covered under the monthly fee will be billed separately, and the Facility shall provide the Resident with a price list for such additional services.

2.3. Payment Schedule: The fees for each month are required to be paid by the first day of every month. If there are instances of delayed payments, a fee corresponding to a pre-set amount may be charged for each day that the payment is late.

2.4. Deposit: Upon the execution of this contract, a deposit will need to be given. This deposit, the value of which is [Amount], serves a specific function within this contractual agreement. It is to be applied to the last month of service that the Resident has under this contract. Therefore, the Resident would not have to provide extra payment during their final month of service as it is covered by the initial deposit made.

3. Admission and Discharge

3.1. Admission Process: The individual who is taking up residence is obligated to finish all the necessary health evaluations that are mandatory. In addition, they must also supply any medical information that is required. These steps are an integral part of the admission process that needs to be completed.

3.2. Discharge Policy: The Resident or the Facility may terminate this Contract with a [Number]-day written notice. Conditions for immediate discharge for cause, including but not limited to non-payment of fees or violation of Facility policies, are outlined herein.

4. Resident Rights and Responsibilities

4.1. Rights: The Resident has the right to respectful and ethical treatment, privacy, access to information, and to voice grievances without discrimination or reprisal.

4.2. Responsibilities: The Resident is responsible for complying with Facility rules and regulations, providing accurate health information, and respecting the rights and property of other residents and staff.

5. Facility Obligations

5.1. The Facility is expected to uphold and maintain the established levels of staffing and ensure the standards of care provided are consistently at par or above the guidelines demanded by the relevant laws and regulations that are in effect and applicable.

5.2. The Facility is wholeheartedly committed to maintaining and upholding the dignity, privacy, and autonomy of the Resident at all times. It ensures that all services, ranging from daily care to health services, are provided with the highest level of professionalism and compassion. The Facility prides itself on the commitment it sees as fundamental to respect and protect the rights of the Resident in every possible way.

6. Amendments and Modifications

This agreement or contract holds the potential for modification or amendment solely under the condition that both the Facility and the Resident, or the Resident's Legal Representative, participate in the creation of a written document that is authentically signed by both parties to confirm these changes.

7. Governing Law

The stipulations and provisions delineating this Contract will be managed, governed by, and made clear through the lens of the legal statutes and regulations that are enforced in this specific jurisdiction of [State/Country]. Furthermore, these conditions will continue to be applicable and put into effect, making no exclusions or allowances for the principles that pertain to the conflicts of laws within that particular jurisdiction.

8. Dispute Resolution

Any disputes arising out of this Contract shall first be attempted to be resolved through mediation. If unresolved, disputes shall be settled by arbitration in accordance with the rules of [Arbitration Association].

9. Entire Agreement
