This contract ("Contract") is entered into on [Month, Day, Year] between [Your Company Name], located at [Your Company Address], hereinafter referred to as the "Facility," and the resident or resident's legal representative, hereinafter referred to as the "Resident," collectively referred to as the "Parties."
I. Background
The Facility operates as a licensed nursing home facility in accordance with the laws and regulations of the United States governing nursing home operations. The Resident desires to reside at the Facility for long-term care, and the Facility agrees to provide such care in accordance with the terms and conditions set forth herein.
II. Purpose
The purpose of this Contract is to outline the responsibilities of both Parties with respect to preventing harm to the Resident while residing at the Facility.
III. Terms and Conditions

No Harm Principle: The Facility agrees to provide care and services to the Resident in a manner that ensures the Resident's safety and well-being. The Facility shall take all reasonable measures to prevent harm to the Resident, including but not limited to falls, medication errors, infections, neglect, abuse, and any other foreseeable risks.

Assessment and Care Planning: The Facility shall conduct a comprehensive assessment of the Resident's physical, mental, and psychosocial needs upon admission and regularly thereafter. Based on the assessment, the Facility shall develop an individualized care plan that addresses the Resident's needs and preferences, with a focus on preventing harm.

Staff Training and Supervision: The Facility shall ensure that all staff members are adequately trained and competent to provide care to the Resident. Staff shall receive training on infection control, fall prevention, abuse prevention, medication management, and other relevant topics. The Facility shall also provide adequate supervision to staff members to ensure compliance with care standards.

Monitoring and Reporting: The Facility shall implement systems for monitoring the Resident's condition and promptly report any changes or concerns to the Resident's physician and legal representative. The Facility shall maintain accurate records of incidents, including falls, injuries, infections, and medication errors, and provide copies to the Resident or legal representative upon request.

Communication and Collaboration: The Facility shall foster open communication and collaboration between staff, residents, families, and healthcare providers. The Facility shall involve the Resident and legal representative in care decisions and regularly update them on the Resident's condition and care plan.

Rights and Responsibilities: The Resident retains all rights guaranteed by law, including the right to make decisions about their care, the right to privacy and dignity, and the right to voice grievances. The Facility shall respect and uphold these rights and ensure that the Resident is treated with respect and dignity at all times.

Compliance with Laws and Regulations: The Facility agrees to comply with all applicable federal, state, and local laws and regulations governing nursing home operations, including but not limited to the Nursing Home Reform Act, the Americans with Disabilities Act, and the Health Insurance Portability and Accountability Act (HIPAA).

Termination of Contract: This Contract may be terminated by either Party with written notice to the other Party. Upon termination, the Facility shall assist the Resident in transitioning to another care setting in accordance with the Resident's wishes and needs.
IV. Acknowledgement
The Parties hereby acknowledge that they have read and understand the terms and conditions of this Contract and agree to be bound by them.
