Party Rental Agreement
1. Parties Involved
This Party Rental Agreement ("Agreement") is entered into between [Rental Company Name], hereinafter referred to as the "Rental Company," and [Client's Name], hereinafter referred to as the "Client." The Rental Company and the Client shall collectively be referred to as the "Parties."
2. Rental Items
The Rental Company agrees to rent to the Client the following items (the "Rental Items"):
Inflatable Bounce House: A colorful, 15'x15' bounce house suitable for children aged 3-10.
Popcorn Machine: A commercial-grade popcorn machine with a vintage design, that includes popcorn kernels and bags for approximately 50 servings.
Folding Tables and Chairs: Six 6-foot folding tables and 40 folding chairs, ideal for seating guests at events and parties.
Karaoke Machine: A portable karaoke machine with a built-in screen and microphone, pre-loaded with a selection of popular songs.
Outdoor Canopy Tent: A 10'x20' waterproof canopy tent with sidewalls, perfect for sheltering outdoor events from sun or light rain.
Cotton Candy Machine: A professional cotton candy machine with assorted flavored sugar and cones for approximately 50 servings.
3. Rental Period
The rental period shall commence on [Start Date] at [Start Time] and terminate on [End Date] at [End Time] unless otherwise agreed upon in writing by both Parties.
4. Rental Fee and Payment Terms
The Client agrees to pay the Rental Company the total rental fee of [Total Rental Fee] for the Rental Items, as outlined in the invoice provided by the Rental Company. Payment shall be made in the following manner:
[Deposit Amount] as a non-refundable deposit to secure the reservation, due upon signing this Agreement.
The remaining balance of [Remaining Balance] shall be paid in full no later than [Due Date].
Additional charges may apply for any extensions to the rental period or damages incurred to the Rental Items during the rental period.
5. Delivery and Pickup
The Rental Company shall deliver the Rental Items to the location specified by the Client on the agreed-upon date and time. The Client shall ensure that someone is present to receive the Rental Items upon delivery. The Client shall return the Rental Items to the Rental Company in the same condition as received, on the agreed-upon date and time.
6. Responsibilities of the Client
The Client shall be responsible for the safekeeping and proper use of the Rental Items during the rental period.
The Client shall not sublease, loan, or otherwise transfer the Rental Items to any third party without prior written consent from the Rental Company.
The Client shall promptly notify the Rental Company of any damages or malfunctions to the Rental Items during the rental period.
7. Liability
The Rental Company shall not be liable for any injuries, damages, or losses arising from the use of the Rental Items, except for damages directly caused by the negligence or willful misconduct of the Rental Company.
8. Termination
Either Party may terminate this Agreement upon written notice to the other Party in the event of a material breach of any provision of this Agreement, which remains uncured for a period of [Number of Days] days following written notice of such breach.
9. Governing Law
This Agreement shall be governed by and construed under the laws of [Jurisdiction]. Any disputes arising under or related to this Agreement shall be resolved exclusively through arbitration in [Jurisdiction] following the rules of the American Arbitration Association.
10. Entire Agreement
This Agreement constitutes the entire understanding and agreement between the Parties concerning the subject matter hereof and supersedes all prior agreements, understandings, negotiations, and discussions, whether oral or written, between the Parties.
