1. Purpose
This Agreement has been specifically constructed with the intent to highlight and reinforce the terms and conditions that will be applied during the provision of training by the Company to the Employee. These terms and conditions will dictate the way in which the Company supplies the training services to the employee. The purpose of this training will be to allow the Employee to amplify their skills, knowledge and abilities that are specifically pertinent to their role within the company.
2. Training Program
The Company agrees to provide the Employee with access to training programs, resources, materials, and facilities necessary to facilitate the Employee's development in areas pertinent to their job responsibilities. The specific details of the training program, including duration, content, and delivery method, shall be mutually agreed upon by both parties.
3. Obligations of the Company
a. Provision of Training: The Company shall ensure that the training provided to the Employee is relevant, comprehensive, and conducted by qualified instructors or trainers.
b. Resources and Support: The Company shall provide the necessary resources, facilities, and support to enable the Employee to fully participate in the training program.
c. Costs: The Company shall bear all costs associated with the training program, including but not limited to tuition fees, course materials, and travel expenses, unless otherwise agreed upon in writing.
4. Obligations of the Employee
a. Participation: The Employee agrees to actively participate in all aspects of the training program and to diligently complete any assignments or assessments required as part of the training.
b. Confidentiality: The Employee agrees to maintain the confidentiality of any proprietary or confidential information disclosed during the training program and to abide by all applicable confidentiality policies of the Company.
c. Reimbursement: If the Employee voluntarily resigns from their position with the Company within 12 months after completing the training program, the Employee agrees to reimburse the Company for the cost of the training program on a pro-rata basis, unless otherwise agreed upon in writing.
5. Confidentiality
The two participating parties are in unanimous agreement on the need to uphold and preserve the confidentiality of any proprietary information or data that is regarded as confidential, which may be disclosed throughout the training program. This will be achieved by adhering to the specific confidentiality policies put in place by the Company and by observing any applicable laws and legislations, along with any relevant regulations.
6. Term and Termination
This Agreement takes effect from the Effective Date and continues until the completion of the designated training program, but can be terminated early mutually or as per its own conditions. In the event of early termination, both parties agree to engage in good faith discussions to determine the appropriate course of action and any associated consequences. Any termination of the Agreement shall not affect the rights and obligations of the parties accrued prior to the termination date.
7. Governing Law
This Agreement shall be governed by and construed by the laws of [Jurisdiction]. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of [Jurisdiction].
