I. Introduction

This Co-Parenting Agreement ("Agreement") is entered into on [Date], by and between [Your Name] ("Parent 1") residing at [Your Company Address] and [Parent 2's Full Name] ("Parent 2") residing at [Parent 2's Address], collectively referred to as the "Parents."

II. Purpose

The fundamental objective of this Agreement resides in the establishment of an organized, systematic framework that is centered on co-parenting. The core pillars of this framework encompass encouragement and enhancement of cooperation and communication between parents, along with maintaining a consistent application of parenting practices and strategies. The primary focus of this approach revolves around the essential welfare and stability of the children who are involved in the process. This Agreement remains applicable and is designed for situations wherein the parents have different living arrangements or marital relationships. These scenarios include cases where the parents have undergone a divorce, are in the process of separating, or are unmarried individuals who are sharing custody of their minor children.

III. Children Covered

This Agreement pertains to the following child(ren) of the Parents:

IV. Legal Custody

The parents have reached an agreement in which they both consent to partake in sharing the legal custody of their children. This essentially means that they will have a joint responsibility when it comes to making major decisions about their children's overall upbringing. The range of decisions they need to make unanimously includes, and is not limited to, determining the form of education their children should receive, handling all matters related to their healthcare, and guiding them toward their religious upbringing.

V. Physical Custody and Parenting Schedule

V.I Primary Residence: The children will primarily reside with either Parent 1 or Parent 2, adhering to the schedule that is set forth below:

a. Weekly Schedule:

  • The children shall reside with [Parent 1/Parent 2] during the following weekdays: Monday, Tuesday, and Wednesday.

  • The children shall reside with the other Parent during the remaining weekdays.

b. Weekend Schedule:

  • The children shall alternate weekends between the Parents, with [Parent 1/Parent 2] having custody from 10:00 AM until 5:00 PM on the respective weekends.

c. Holiday Schedule:

  • The Parents shall alternate major holidays, such as Thanksgiving, Christmas, New Year's, etc., on an annual basis.

  • Each Parent shall have custody of the children for Thanksgiving, Christmas/New Year, and Easter in odd-numbered years and Spring Break in even-numbered years.

d. Summer Schedule:

  • The children shall spend (4) consecutive weeks of the summer vacation with each Parent, alternating on an annual basis.

e. School Breaks and Vacations:

  • School breaks and vacations shall be divided equally between the Parents, with arrangements made in advance and consideration of the children's best interests.

f. Special Circumstances:

  • In the event of special circumstances, such as birthdays, family events, or other significant occasions, the Parents shall make reasonable accommodations to ensure the children's participation and well-being.

V.II Visitation Schedule: The Parent who does not have the primary residential custody of the child should be allowed to have visitation rights, and those visitation rights will be provided to them with the following conditions and procedures:

a. Weekly Visitation:

  • Every Wednesday and Friday, from 4:00 PM to 8:00 PM, the non-residential Parent shall have visitation rights with the children.

b. Midweek Visitation:

  • Additionally, the non-residential Parent shall have visitation rights on Tuesdays, from 4:00 PM to 8:00 PM, on weeks when they do not have overnight visitation.

c. Alternate Weekends:

  • The non-residential Parent shall have visitation rights every other weekend, commencing from 6:00 PM on Friday until 6:00 PM on Sunday.

d. Holiday Visitation:

  • The non-residential Parent shall have visitation rights during Thanksgiving, Christmas/New Year, and Easter in odd-numbered years as outlined in Section VI of this Agreement.

e. Extended Visitation:

  • The non-residential Parent shall have the option for extended visitation during the children's summer break, with two consecutive weeks from July 1st to July 15th, as agreed upon by both parents in advance.

  • V.III Holiday and Special Occasions: The Parents shall alternate holidays and special occasions, such as birthdays, Thanksgiving, Christmas, etc., fairly and equitably.

VI. Communication

The parents have mutually agreed upon the necessity to consistently uphold open and respectful communication, about all matters directly or indirectly concerning the welfare, education, and upbringing of the children. Agreeing on this important issue, the parents have identified potential communication methods including, but not exclusive to, telephonic conversation, exchange of text messages, email correspondence, as well as in-person discussions and meetings, all serving to ensure effective co-parenting.

VII. Decision-Making

In circumstances where there is a disagreement between the parents regarding significant decisions related to the well-being of the children, it is agreed upon by the parents that they will involve themselves in a process of mediation or they will seek the assistance of legal counsel. They are committed to undertaking these measures as a means to settle any disputes they encounter, prioritizing the interests of the children at all times.

VIII. Financial Responsibilities

VIII.I Child Support: The parents have expressed their agreement to adhere to any child support obligations as ordered by the court. Furthermore, should there exist any financial arrangements devised and mutually agreed upon to support their children, the parents have also agreed to abide by these arrangements.

VIII.II Extraordinary Expenses: The parents involved have an express agreement, mention of which must be made, to bear the burden of any extraordinary expenses related to the children on an equal footing. Extraordinary expenses refer to those costs which are not routine and may arise due to various circumstances. This can involve costs stemming from medical treatments or procedures that are not covered under any existing insurance policies. It can also include educational expenses like tuition fees, costs of textbooks, stationery, and other academic necessities.

IX. Dispute Resolution

If disagreements or controversies arise under the terms of this Agreement, the Parents have collectively agreed that they will attempt to resolve such issues through the utilization of mediation. Only after exhausting this preferred method of resolution, if no satisfactory settlement can be reached, will they then consider resorting to the pursuit of litigation as a means of settling their disagreements.

X. Modification of Agreement

This Agreement retains the potential for modification or amendment at any given point in time, granted that the alterations are mutually agreed upon and confirmed in writing by both parents. Furthermore, it must be ensured that any such modifications are executed with the primary intention of serving the best interests of the children.

XI. Governing Law

This Agreement, in its entirety, will be under the jurisdiction of and will be understood, interpreted, and implemented by the laws of the [State/Country] where it is applicable.

XII. Entire Agreement

This Agreement represents the total comprehension between the entities or parties involved concerning the matter in question herein. It takes over and replaces all preceding agreements and understandings, irrespective of whether they were documented in writing or expressed verbally, which are connected or related to the aforementioned matter.
