1. Introduction
This Family Caregiver Contract ("Contract") is entered into on [Date] between [YOUR NAME], hereinafter referred to as the "Care Recipient," and [Caregiver's Name], hereinafter referred to as the "Caregiver." This Contract outlines the terms and conditions of caregiving responsibilities to be provided by the Caregiver to the Care Recipient.
2. Duties and Responsibilities
2.1 Personal Care:
The Caregiver agrees to assist with personal care tasks, including bathing, dressing, grooming, and toileting, as required by the Care Recipient.
2.2 Medication Management:
The Caregiver agrees to assist the Care Recipient with medication management, including administering medication according to prescribed instructions and maintaining accurate records of medication intake.
2.3 Mobility Assistance:
The Caregiver agrees to assist the Care Recipient with mobility, transfers, and transportation as necessary, ensuring the safety and well-being of the Care Recipient.
2.4 Meal Preparation:
The Caregiver agrees to prepare nutritious meals and snacks for the Care Recipient, taking into account any dietary restrictions or preferences.
2.5 Household Tasks:
The Caregiver agrees to perform light household tasks, such as cleaning, laundry, and organizing, to maintain a clean and safe environment for the Care Recipient.
2.6 Companionship:
The Caregiver agrees to provide companionship and emotional support to the Care Recipient, engaging in activities and conversations to promote mental well-being.
3. Schedule
3.1 Working Hours:
The Caregiver's working hours shall be 9:00 AM to 5:00 PM, Monday to Friday, as mutually agreed upon by both parties.
3.2 Overtime and Additional Hours:
Any additional hours worked beyond the agreed schedule shall be compensated at the rate specified in Section IV.
3.3 Time Off:
The Caregiver is entitled to 10 days of paid time off per year, to be scheduled in advance and agreed upon by both parties.
4. Compensation
4.1 Hourly Rate:
The Caregiver shall be compensated at the rate of $15 per hour for regular working hours.
4.2 Overtime Rate:
Overtime hours shall be compensated at a rate of $22.50 per hour, calculated for each additional hour worked beyond the regular schedule.
4.3 Payment Schedule:
Payment shall be made every week, on Fridays, via direct deposit.
5. Termination
5.1 Notice Period:
Either party may terminate this Contract with a 30-day written notice to the other party.
5.2 Reasons for Termination:
This Contract may be terminated by either party for reasons including but not limited to mutual agreement, breach of contract, or changes in the Care Recipient's care needs.
6. Confidentiality
The Caregiver agrees to maintain the confidentiality of all personal and medical information about the Care Recipient, refraining from disclosing such information to any third party without explicit consent.
7. Governing Law
This Contract shall be governed by and construed by the laws of the State of California, and any disputes arising out of or in connection with this Contract shall be resolved through arbitration by the laws of the State of California.
8. Entire Agreement
This Contract constitutes the entire agreement between the Caregiver and the Care Recipient, superseding any prior agreements or understandings, written or oral, relating to the subject matter herein.
