This Lawn Maintenance Contract ("Contract") is entered into as of this 1st day of January 2050 (the "Effective Date") by and between Agustin Jerde, an individual residing at Fort Worth, TX 76101 (the "Client"), and [Your Company Name], a company with its principal place of business located at [Your Company Address] (the "Contractor"). This Contract sets forth the terms and conditions under which the Contractor agrees to provide lawn maintenance services to the Client.


I. Scope of Work

The Contractor shall provide lawn maintenance services, including but not limited to the following:

1.1 Lawn Mowing

The Contractor will mow the Client’s lawn on a weekly/bi-weekly basis during the growing season, from March to November, or as otherwise agreed upon by the parties.

1.2 Weed Control

The Contractor will perform weed control measures, including the application of herbicides, to ensure that the Client’s lawn remains free from weeds throughout the growing season.

1.3 Fertilization

The Contractor will apply fertilizers to the Client’s lawn as necessary to promote healthy growth and to maintain the aesthetic quality of the lawn.

1.4 Edging and Trimming

The Contractor will edge and trim around all lawn borders, trees, shrubs, and other obstacles to maintain a neat appearance.

1.5 Irrigation System Maintenance (if applicable)

The Contractor will inspect and adjust the Client’s irrigation system to ensure it operates efficiently and provides adequate coverage for the lawn.


II. Term and Termination

2.1 Contract Term

This Contract shall begin on January 1, 2050, and shall continue until December 31, 2050, unless terminated earlier in accordance with the terms set forth herein.

2.2 Termination

Either party may terminate this Contract with 30 days written notice to the other party. In the event of termination, the Client shall pay the Contractor for all services rendered up to the date of termination.

2.3 Renewal

This Contract may be renewed for additional terms upon mutual agreement of both parties, subject to the same terms and conditions or as otherwise agreed.


III. Compensation

3.1 Payment Schedule

The Client agrees to pay the Contractor a total sum of $[Amount] per month/quarter, due on the [1st day of each month]. Payment is to be made via check, credit card, or electronic transfer to the Contractor's designated account.

3.2 Late Payment

Any payment not received within ten (10) days of the due date will incur a late fee of $[Late Fee Amount]. Additionally, the Contractor reserves the right to suspend services until all outstanding payments are made.

3.3 Additional Charges

Any services not included in the scope of work and requested by the Client shall be subject to additional charges, which shall be mutually agreed upon in writing before such services are rendered.


IV. Contractor’s Obligations

4.1 Provision of Services

The Contractor shall provide the services outlined in this Contract in a timely and professional manner, utilizing qualified personnel and appropriate equipment.

4.2 Compliance with Laws

The Contractor shall comply with all applicable local, state, and federal laws in the performance of services under this Contract.

4.3 Liability Insurance

The Contractor shall maintain liability insurance sufficient to cover any damages or injuries caused by the Contractor's work. Proof of insurance will be provided to the Client upon request.


V. Client’s Obligations

5.1 Access to Property

The Client agrees to provide the Contractor with access to the property at reasonable times to perform the services described in this Contract.

5.2 Cooperation

The Client agrees to cooperate with the Contractor, including providing necessary access to water, power, or other resources that may be needed to perform the services.

5.3 Payment

The Client agrees to make timely payments for the services rendered by the Contractor, in accordance with the terms of this Contract.

5.4 Maintenance of Property

The Client agrees to maintain the property in a manner that is conducive to the Contractor’s ability to perform the services. This includes but is not limited to keeping lawn furniture, pets, or other obstacles out of the lawn area during scheduled service visits.


VI. Governing Law

This Contract shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.


VII. Dispute Resolution

7.1 Negotiation

In the event of any dispute or disagreement arising out of or in connection with this Contract, the parties agree to first attempt to resolve the matter through direct negotiation.

7.2 Mediation

If the dispute is not resolved through negotiation, the parties agree to submit the dispute to mediation before a mutually agreed-upon mediator.

7.3 Arbitration

If mediation does not resolve the dispute, the parties agree to submit the dispute to binding arbitration in the State of Texas, under the rules of the American Arbitration Association.


VIII. Indemnification

The Client agrees to indemnify and hold the Contractor harmless from any and all claims, damages, or liabilities arising from the Client's failure to maintain the property or from the Client's negligence.

IX. Entire Agreement

This Contract represents the entire agreement between the parties and supersedes all prior discussions, agreements, and understandings, whether written or oral, between the parties regarding the subject matter of this Contract.
