1. Introduction

2. Purpose
This Contract has been crafted and implemented to explicitly define the terms and conditions under which the sterilization procedure (which could be spaying or neutering) will be performed on the pet animal. This animal belongs to the Owner, and additional specific details related to this procedure are provided below in the document. The overall purpose of this legal contract is to establish clear expectations and responsibilities during the sterilization procedure, preventing miscommunication and ensuring that both parties are fully aware of their respective obligations.
3. Procedure Details

3.2 Date of Procedure:

The Owner agrees to pay the Clinic the sum of $200 for the neutering procedure, inclusive of all associated costs such as anesthesia, surgical materials, post-operative care, and medications.
4. Responsibilities of the Clinic
4.1 Professional Standards:
The Clinic is in agreement and fully commits to carrying out the neutering procedure, ensuring that the procedure is performed with the utmost standard of care. In addition, the veterinary clinic promises to adhere strictly to the best practices within the veterinary field when carrying this procedure out.
4.2 Pre-Operative Examination:
The medical establishment, referred to in this context as The Clinic, is officially bound by duties to carry out a comprehensive examination before an operation, referred to as a pre-operative examination, specifically on the animal that is owned by an individual for the purpose of companionship, more commonly called a pet. This examination is undertaken with the main objective to ascertain whether this pet animal is in a suitable health condition that would permit it to endure the upcoming surgical procedure.
4.3 Anesthesia and Surgery:
The clinic is mandated to administer the appropriate anesthesia that is necessary for the procedure. Following the administration of the anesthesia, the clinic is expected to proceed with the neutering surgery. It is of utmost importance that these profound tasks are carried out by professionals in the veterinary field who have the required qualifications and skills to perform such delicate procedures.
4.4 Post-Operative Care:
The Clinical facility has a responsibility to provide all necessary care after operations for the pet animal, which are essential for its proper recuperation and overall well-being. This care also involves supplying the Owner with detailed instructions to ensure that the pet animal recovers successfully in the post-operative phase.
5. Responsibilities of the Owner
5.1 Consent:
The individual who is the acknowledged legal owner has given their full understanding and consent allowing the procedure of neutering to be performed on the pet animal that they own and hold responsibility for.
5.2 Health Disclosure:
The individual who owns the pet animal is required to disclose any health issues that are already known or any previous medical history pertaining to the pet animal to the veterinary clinic prior to the administration of any medical procedure.
5.3 Follow-Up Care:
The person who is the owner of the pet has given their contract and has therefore pledged to strictly adhere to and comply with all the instructions that are provided by the Clinic regarding the care that should be given after surgery (post-operative care). These instructions are specifically given with the aim of ensuring the most effective recovery process and optimal health for the pet.
5.4 Financial Obligations:
The owner of the pet has the responsibility to make a payment to the Clinic for the neutering procedure. This payment is based on a fee that has been previously agreed upon by both parties. The payment must be made either prior to the date of the neutering procedure or on the same day that the procedure is to occur.
6. Cancellation and Refund Policy
If the Owner cancels the neutering procedure, a refund of 50% of the total fee shall be provided if the cancellation occurs 7 days before the scheduled date. Cancellations made less than 7 days before the scheduled date shall not be eligible for a refund.
7. Liability and Indemnification
7.1 Limitation of Liability:
The clinic does not hold any responsibility or liability for any complications or adverse events that might arise subsequent to the neutering procedure. However, this stipulation is based on the assumption that the neutering operation has been executed consistent with the standard methods and techniques universally acknowledged and practiced by the veterinary profession.
7.2 Indemnification:
The Owner agrees to indemnify and hold harmless the Clinic, its veterinarians, employees, and agents from any claims, liabilities, damages, or expenses arising from or related to the neutering procedure.
8. Governing Law and Dispute Resolution
This Contract shall be governed by the laws of the State of California. Any disputes arising under or in connection with this Contract shall be resolved through mediation or arbitration by the rules of the American Arbitration Association, with the prevailing party entitled to recover reasonable attorney fees and costs.
9. Entire Agreement
This Contract constitutes the entire agreement between the Clinic and the Owner concerning the neutering procedure and supersedes all prior agreements and understandings, whether oral or written.
