Fitness Contract

This Fitness Contract (the "Contract") is entered into by and between [Fitness Professional Name], located at [Fitness Professional Address] (the "Service Provider") and [Client Name], located at [Client Address] (the "Client") (collectively, the "Parties"), is effective as of [Effective Date].

I. Services Provided

1.1 Description of services

  • Personal Training: Workout sessions that are tailored specifically to focus on the individual fitness goals and needs of each person.

  • Group Fitness Classes: You will have access to various group fitness classes, including but not limited to yoga, spin, and Zumba. The availability of these classes and when they will take place can be found on the schedule.

  • Nutritional Counseling: Consultations and guidance on dietary habits, meal planning, and nutrition education.

1. 2 Frequency of sessions/classes

  • Personal Training: There will be three sessions every week, with each session having a duration of approximately sixty minutes.

  • Group Fitness Classes: You will have unlimited access to all classes that are scheduled throughout the entire month.

  • Nutritional Counseling: Each month, there will be a single session, in which each of these sessions is expected to go on for approximately forty-five minutes.

1.3 Additional services included

  • Fitness Assessments: Comprehensive fitness evaluations are conducted at the beginning and every 3 months during the training period to track progress.

  • Meal Plans: Customized meal plans designed to complement fitness goals and nutritional requirements, updated quarterly during counseling sessions.

II. Membership Details (if applicable)

2.1 Type of Membership

  • A membership that requires renewal every month.

2.2 Membership fees

  • Membership fees: $100 per month

  • Payment schedule: Monthly

  • Taxes: Taxes included in the membership fees

2.3 Terms for renewal or termination of membership

  • Automatic Renewal: The membership will automatically renew each month unless the Client provides written notice of termination at least 30 days before the renewal date.

  • Notice period for termination: The Client must provide written notice of termination at least 30 days before the desired termination date. Termination will be effective at the end of the current billing cycle.

III. Terms and Conditions

The Client agrees to abide by the rules and regulations of the fitness facility, including but not limited to:

  1. Proper use of equipment and facilities: The Client agrees to use all fitness equipment and facilities responsibly and as intended, following instructions provided by staff or trainers to prevent damage or misuse.

  2. Dress code and hygiene standards: The Client agrees to adhere to the designated dress code, such as appropriate workout attire and footwear, and maintain proper personal hygiene during fitness activities for the safety and comfort of themselves and others.

  3. Compliance with safety instructions and guidelines: The Client agrees to follow all safety instructions, guidelines, and protocols established by the fitness facility, trainers, or staff to ensure a safe workout environment, including proper warm-up, cooldown, and use of safety equipment when necessary.

IV. Cancellation and Rescheduling

  1. Client's notice for session/class cancellations or rescheduling: The client is required to give a minimum notice of 24 hours if they wish to cancel a session. Failure to do so would likely lead to penalties or fines, depending on the terms and conditions agreed upon. rescheduling.

  2. The provider's right to charge a fee for missed appointments without sufficient notice: The provider reserves the right to charge a cancellation fee equivalent to 50% of the session/class fee for appointments canceled or rescheduled with less than 24 hours' notice or for no-show appointments without prior notification.

V. Health and Safety: Client Acknowledgment

  • The Client acknowledges that they are physically fit to participate in fitness activities and have no medical conditions that would prevent safe participation.

  • The Client agrees to notify the service provider of any changes in their health status that could affect their ability to safely participate in activities. This includes, but is not limited to, any symptoms, illnesses, or conditions that could endanger their safety or welfare during participation.

VI. Liability Waiver

The Client acknowledges and assumes the risks associated with physical exercise and releases the Provider from any liability for injuries, damages, or losses incurred during fitness sessions/classes, except in cases of gross negligence or misconduct by the Provider.

VII. Duration and Termination

This Contract shall commence on the mutually agreed [Start Date] and remain in effect until terminated by either party with a minimum of 30 days' written notice. Immediate termination is permissible in case of a material breach, defined as a substantial violation significantly affecting either party's ability to fulfill obligations.
