II. Performance Details
2.1 Type of Performance

2.2 Duration of Performance
Performance duration includes breaks and varies by type: concerts/plays typically last 1.5-3 hours, while dances/comedy shows run for 1-2 hours, ensuring clarity in event planning.
2.3Technical Requirements

Microphones: 3 wired (e.g., Shure SM58) and 2 wireless (e.g., Sennheiser EW 100 G4).
Mixer: Digital mixer with at least 16 channels (e.g., Behringer X32, Yamaha TF Series).
Speakers: 2 main speakers (15-inch) with subwoofers.
Monitors: 4-stage monitors with adjustable positioning.

Stage Lights: 12 LED pars, 2 moving head spotlights.
Effects Lights: 4 strobe lights, 2 laser lights.
Lighting Controller: DMX lighting control system.
Lighting Cues: Custom lighting cues as per the performance script.

Piano: 88-key digital piano tuned to A440.
Drums: Full drum kit with standard components.
Guitars/Bass: 2 electric guitars, 1 bass guitar with appropriate amplifiers.

Stage Size: 20' x 15' with 2' drum platform.
Risers/Platforms: 2 adjustable risers, 1 drum riser.
Backline Equipment: Guitar and bass amplifiers, if needed.
III. Compensation
3.1 Financial Agreement
The performance fee is $5000: $1500 deposit due at contract signing, remaining $3500 due two weeks before the performance on [Date].
3.2 Expenses
The Performer bears the cost of all performance-linked expenses not supplied by the Venue, which will provide the agreed-upon technical tools and staff. Unforeseen costs need written agreement from both parties before action.
IV. Promotion and Marketing
4.1 Promotion and Marketing Responsibilities
Both performer and venue will collectively promote the event, with the performer leveraging their social media, website, and mailing lists, and the venue featuring the event on their website, social media, and promotional materials.
4.2 Promotional Materials
In this pact, all parties engaged will cooperatively engage in devising promotional items, like print posters or digital ads, among other possibilities. The promotional resources, after creation, will receive the joint approval of both parties. There will be expenses tied to the design and production of these resources, which will be apportioned fairly, with each party shouldering half of the total costs, subsequently allowing for an equitable sharing of the accumulated costs.
4.3 Costs Sharing/Responsibilities
The Performers will pay for their promotions like social media advertising, while the Venue covers its promotion costs such as venue signage. Both parties will agree in advance on any extra promotional expenses.
V. Cancellation
5.1 Cancellation Policy
In the event of cancellation, both parties agree to adhere to the following terms. The Notice Period for Cancellation is set at 30 days, requiring either party to provide advance notice of cancellation. Failure to provide timely notice may result in penalties as outlined below.
5.2 Penalties for Cancellation
If either party cancels the performance within the Notice Period, the cancelling party shall be liable to pay a cancellation fee of 50% of the total agreed fee to the non-cancelling party. This fee is intended to compensate for any losses incurred due to the cancellation.
VI. Insurance and Liability
6.1 Insurance Coverage
The Performer and the Venue, both parties involved in the engagement, are required to maintain comprehensive insurance coverage specifically tailored toward the event in question. This coverage should be active and in full effect for the entire duration of the event.
6.2 Indemnification Clause
Each party agrees to indemnify and hold harmless the other party, its agents, employees, and representatives from and against any claims, damages, liabilities, costs, and expenses arising out of or related to:

7.1 Merchandising Rights and Recording
The Performer alone can sell event merchandise. The Venue needs permission for unauthorized merchandise. Rights include audio/video, live streaming, and distribution as agreed. Extra recording or broadcasting needs consent from both.
7.3 Distribution of Revenue
Revenue from merchandise and recordings will be shared as agreed, with detailed percentages, accounting procedures, and payment schedules outlined in the contract. Both parties commit to maintaining accurate financial records and transparent revenue reporting.
VIII. Legal Jurisdiction
Disputes shall be governed by the laws of [Insert Jurisdiction], with [City/State/Country] courts having exclusive jurisdiction. Both parties commit to resolving disputes through mediation or arbitration before litigation.
