Sperm Donor Contract

This Sperm Donor Contract ("Contract")is hereby executed on the contract date, between [Sperm Donor Name], of [Sperm Donor Address], hereinafter referred to as the “Donor”, and [Intended Parent Name], of [Intended Parent Address], hereinafter referred to as the “Recipient(s)”.

I. Sperm Donation Process

• The parties agree that the sperm donation will take place at [Name of Licensed Clinic], located at [Clinic Address], which is a licensed medical facility specializing in reproductive services. The Sperm Donor agrees to coordinate with the clinic's staff to provide the necessary samples for artificial insemination procedures.

• Alternatively, if the parties opt for a private arrangement, the sperm donation will take place at [Location], agreed upon by both parties. This location should be conducive to the sperm donation process and ensure proper storage and handling of the samples following medical standards.

II. Parental Rights and Responsibilities

2.1 Sperm Donor's Relinquishment of Parental Rights and Responsibilities

1. The Sperm Donor agrees not to assert any parental rights or claim any legal or custodial relationship with any child conceived through the sperm donation process.

2. The Sperm Donor acknowledges that they will not have any financial, legal, or custodial obligations towards any resulting offspring.

3. The Sperm Donor agrees not to seek custody, visitation rights, or any other form of parental involvement in the upbringing or care of any child conceived through sperm donation.

2.2 Intended Parent(s) Assumption of Parental Responsibility

1. The Intended Parent(s) agree to assume full legal and custodial responsibility for any child conceived through the sperm donation process.

2. The Intended Parent(s) acknowledge that they will have the sole authority to make decisions regarding the upbringing, education, healthcare, and general welfare of the child.

3. The Intended Parent(s) agree to provide financial support, emotional care, and a stable environment for the child's upbringing.

4. The Intended Parent(s) agree to legally establish parentage of the child through appropriate legal procedures, if necessary, to ensure their rights and responsibilities as legal parents.

III. Financial Arrangements

3.1 Financial Compensation for the Sperm Donor

The Intended Parent(s) agree to provide financial compensation to the Sperm Donor in the amount of [Amount] for each sperm donation procedure.

• The parties agree that the financial compensation covers the time, effort, and inconvenience associated with the sperm donation process.

• The financial compensation will be provided to the Sperm Donor within 5 business days following each completed sperm donation procedure.

3.2 Expenses Related to the Sperm Donation Process

• The Intended Parent(s) agree to cover all medical expenses associated with the sperm donation process, including but not limited to

  a. Costs of medical screening and testing for the Sperm Donor.

  b. Fees for sperm collection and storage at the designated facility.

  c. Any necessary medical procedures or treatments related to the artificial insemination process.

• The Sperm Donor will not be responsible for any expenses incurred during the sperm donation process, including but not limited to medical, travel, or legal expenses.

IV. Medical Screening and Testing

4.1 Sperm Donor

• The Sperm Donor agrees to undergo required medical screening and testing, including STI testing, genetic testing, and a physical examination to ensure suitability for sperm donation.

• Documentation of medical clearance from a licensed healthcare provider is required.

4.2 Intended Parent(s)

• The Intended Parent(s)/Recipient(s) agree to undergo necessary medical screening and testing, including fertility assessment, screening for medical conditions, and genetic counseling.

• Documentation of medical clearance from a licensed healthcare provider is required.

V. Confidentiality and Privacy

Both parties agree to maintain strict confidentiality regarding the sperm donation arrangement and the Sperm Donor's identity unless explicitly agreed upon. Anonymity for the donation will be determined by mutual agreement, with options for full anonymity or identity disclosure. Any exchanged information will remain confidential and requires written consent from both parties for sharing with third parties.

VI. Legal Considerations

The stipulations represented in this Contract will be overseen and regulated by the laws, rules, and guidelines of the specified jurisdiction. Furthermore, both parties involved in this agreement confirm that they have sought out and received advice from legal counsel. They also acknowledge and fully comprehend the potential legal ramifications that may stem from entering into this particular agreement.

VII. Termination Clause

This Contract may be terminated by either party upon written notice to the other party. The notice period for termination shall be 30 days during which both parties agree to fulfill any remaining obligations outlined in this agreement.
