CELL PHONE CONTRACT
This Cell Phone Contract ("The Contract") is entered into as of [Effective Date] ("Effective Date"), by and between [Your Name], of [Your Company Address] (hereinafter referred to as the "Company"), and [Client's Name], of [Client's Address] (hereinafter referred to as the "Client").
1. SERVICES PROVIDED
1.1 The Company agrees to provide the Client with a dedicated customer service hotline for technical support and assistance. The hotline shall be available 24 hours a day, 7 days a week.
1.2 The Company shall provide regular updates and notifications regarding new features, updates, and promotions related to the Service. These updates shall be communicated via email, SMS, and the Company's mobile app.
1.3 The Company shall conduct a quarterly review of the Client's usage patterns to recommend the most suitable service plan for their needs.
1.4 The Company shall provide a detailed breakdown of all charges on the Client's monthly bill, including service fees, taxes, and any additional charges.
1.5 The Company shall offer discounts on accessories and device upgrades to loyal customers who have been with the Company for over two years.
1.6 The Company shall provide the Client with a loaner device free of charge in the event that the Client's device requires repairs.
2. DEVICE
2.1 The Company shall provide the Client with the latest model of the Device, subject to availability and compatibility with the Service. The Client may request a specific model, which the Company will provide if available.
2.2 The Device shall be covered under the manufacturer's warranty for the duration of this Contract. Any repairs or replacements needed under warranty shall be provided by the manufacturer or authorized service center.
2.3 The Company shall offer device insurance to the Client at a discounted rate, covering loss, theft, and accidental damage.
2.4 The Client may choose to purchase an extended warranty for the Device, which will provide coverage beyond the manufacturer's warranty period.
2.5 The Client shall be responsible for any damage to the Device that is not covered under warranty or insurance.
2.6 The Company shall provide software updates for the Device to ensure optimal performance and security.
3. SERVICE PLAN
3.1 The Service plan includes unlimited calling and texting within the country, with additional charges for international calls and texts. The plan also includes a specified amount of data usage per billing cycle, with reduced speeds for exceeding the limit.
3.2 The Service plan may be upgraded or downgraded by the Client at any time, subject to the terms and conditions of the plan. Any changes to the plan shall take effect from the next billing cycle.
3.3 The Company shall notify the Client when they are approaching their data limit for the billing cycle, to avoid unexpected charges.
3.4 The Company shall provide the Client with a monthly usage report, detailing their usage of minutes, texts, and data.
3.5 The Client may opt to purchase additional data packages if needed, subject to availability and pricing.
3.6 The Client shall have access to the Company's mobile app, which provides information about their service plan, usage, and billing.
4. PAYMENT
4.1 The Client shall pay the Company a total fee of [Total Amount], payable as follows: [Payment Schedule]. The Company will invoice the Client for the amount due under the Contract, and payment is due upon receipt of the invoice.
4.2 The Client may choose to enroll in automatic bill payment, where the payment is deducted from their chosen payment method on the due date.

5. CANCELLATION AND RESCHEDULING

5.2 The Client may reschedule their service appointment up to [Number] times without incurring any additional fees. Subsequent rescheduling may be subject to a rescheduling fee.
5.3 The Company reserves the right to cancel or reschedule the Client's service appointment due to unforeseen circumstances, including but not limited to inclement weather, equipment failure, or staff unavailability. The Company shall notify the Client as soon as possible in such cases.
5.4 The Client shall provide at least [Number] hours' notice for any cancellation or rescheduling of their service appointment. Failure to provide sufficient notice may result in a cancellation fee.

6. OWNERSHIP AND MAINTENANCE
6.1 The Client is responsible for any damage to the Device not covered under warranty or insurance. The Client shall bear the cost of repair or replacement of the Device in such cases.
6.2 The Client shall maintain the Device in good working condition and shall not use it for any illegal or unauthorized purposes.
6.3 The Company shall provide regular maintenance and software updates for the Device to ensure optimal performance and security.
7. LIMITATION OF LIABILITY
7.1 The Company's liability for any claim, loss, or injury arising from the Company's performance under this Contract is limited to the return of all payments made by the Client.
7.2 The Company shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of the Service or the Device.
7.3 The Company shall not be liable for any damages caused by third-party apps or services installed on the Device by the Client.
8. CONFIDENTIALITY
8.1 All information related to this Contract is confidential and may not be disclosed to third parties without the written consent of both the Company and the Client.
8.2 The Company shall take all necessary measures to protect the Client's personal information and shall not disclose it to unauthorized parties.
8.3 The Client's usage data, including but not limited to call logs, text messages, and data usage, shall be treated as confidential and shall not be disclosed to third parties without the Client's consent.
9. ENTIRE AGREEMENT
This Contract constitutes the entire agreement between the Company and the Client and supersedes all prior oral and written agreements. This Contract can only be modified in writing and signed by both parties.
10. SERVICE INTERRUPTIONS
10.1 The Company shall make reasonable efforts to minimize service interruptions due to maintenance or upgrades. The Company shall notify the Client in advance of any planned maintenance that may result in service interruptions.
10.2 In the event of a service interruption caused by factors beyond the Company's control, such as natural disasters or network outages, the Company shall not be liable for any damages or losses incurred by the Client.
10.3 The Company shall provide the Client with updates regarding the status of any service interruptions and the estimated time for restoration of service.
11. WARRANTY
11.1 The Company warrants that the Service will be provided with reasonable care and skill and in accordance with industry standards.
11.2 The Company does not warrant that the Service will be uninterrupted, timely, secure, or error-free.
11.3 The Company shall not be liable for any loss or damage arising from the Client's use of the Service or the Device, including but not limited to loss of data, loss of revenue, or loss of business opportunity.
12. DATA USAGE
12.1 The Client shall be responsible for monitoring their data usage to avoid exceeding the limit set by their service plan. The Company shall not be liable for any charges incurred due to exceeding the data limit.
12.2 The Company shall provide tools and resources to help the Client monitor their data usage and manage their account.
12.3 The Client may request a data usage report from the Company at any time to review their usage patterns and make informed decisions about their service plan.
13. INSURANCE
13.1 The Client may choose to purchase insurance for the Device, which will cover loss, theft, and accidental damage. The cost of insurance shall be determined by the insurance provider.
13.2 The Client shall be responsible for filing any insurance claims related to the Device and shall cooperate with the insurance provider in the claims process.
13.3 The Company shall not be liable for any damages or losses incurred by the Client that are covered by insurance.
