Equine Release Of Liability
I. Introduction
This Equine Release of Liability Agreement ("Agreement") is entered into between [YOUR NAME], located at Atlanta, GA 30301, hereinafter referred to as the "Organizer," and the undersigned Trace Durgan, hereinafter referred to as the "Participant," to engage in horseback riding lessons.
II. Assumption of Risk
The Participant acknowledges that horseback riding lessons involve inherent risks, including but not limited to falls, collisions, equipment failure, and the unpredictable behavior of horses. The Participant understands and voluntarily assumes all risks associated with horseback riding lessons, including the risk of serious injury or death.
III. Release and Waiver
In consideration of being permitted to participate in horseback riding lessons, the Participant hereby releases, waives, and forever discharges the Provider, its owners, employees, agents, and affiliates from any liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death, including those resulting from the negligence of the Provider or its employees or agents.
IV. Responsibilities of the Participant
The Participant agrees to follow all instructions provided by the Provider or its representatives during horseback riding lessons. The Participant agrees to wear appropriate safety gear, including but not limited to helmets and riding boots, and to use equipment properly and responsibly.
V. Assumption of Responsibility
The Participant acknowledges that the care, custody, and control of horses involved in the horseback riding lessons remain with the Provider. The Participant agrees not to hold the Provider responsible for the actions or behaviors of the horses.
VI. Medical Authorization
The Participant authorizes the Provider to seek emergency medical treatment on behalf of the Participant in the event of injury or illness during horseback riding lessons. The Participant agrees to assume all costs associated with such medical treatment.
VII. Indemnification
The Participant agrees to indemnify, defend, and hold harmless the Provider, its owners, employees, agents, and affiliates from and against any claims, damages, liabilities, costs, and expenses, including attorney fees, arising out of or related to the Participant's participation in horseback riding lessons.
VIII. Governing Law
This Agreement shall be governed by and construed following the laws of Georgia, without regard to its conflict of law principles.
IX. Severability
If any provision of this Agreement is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired.
X. Entire Agreement
This Agreement constitutes the entire agreement between the parties about the subject matter hereof and supersedes all prior and contemporaneous agreements, representations, and understandings, whether oral or written.
