Release Of Liability For Adult Exercise Facility

I. Introduction

• Identification of the Parties: This Release of Liability ("Agreement") is entered into between [Fitness Center], located at 2334 Lucky Duck Drive

  Monroeville, PA 15146, herein referred to as the "Facility," and the undersigned individual, [Name of Patron], herein referred to as the "Patron."

• Purpose of the Document: The purpose of this Agreement is to outline the terms and conditions under which the Patron voluntarily participates in physical exercise activities provided by the Facility.

II. Assumption of Risk

• Explanation of Inherent Risks: The Patron acknowledges that participation in physical exercise activities, including but not limited to, the use of exercise equipment, group fitness classes, and personal training sessions, carries inherent risks of physical injury, such as strains, sprains, fractures, and in extreme cases, catastrophic injuries or death.

• Acknowledgment of Understanding: By signing this Agreement, the Patron confirms understanding of the inherent risks associated with participation in physical exercise activities and voluntarily assumes all such risks.

III. Health Status Acknowledgment

• Requirement of Good Physical Condition: The Patron hereby gives their assurance that they are in a suitable state of physical health and well-being and that there are no prevailing medical conditions or health issues that would inhibit or restrain their ability to wholly partake and engage in the activities that are conducted or provided by the Facility.

• Responsibility for Medical Consultation: The individual, here referred to as the Patron, is fully aware and acknowledges the responsibility that they hold. This responsibility pertains specifically to the need to consult with a professional medical expert, such as a physician, in cases where involvement in any exercise-related activities is being considered.

• This is particularly significant and necessary if the Patron has any worries or uncertainties concerning their overall health or their capability to partake in the said activities. This step is crucial to ensure their safety and well-being during their participation in any physical exercise activities.

IV. Release of Liability

• Waiver of Claims and Legal Actions: The Patron hereby releases, waives, and forever discharges the Facility, its owners, employees, agents, representatives, instructors, and volunteers from any liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury sustained by the Patron while participating in the activities provided by the Facility.

• Exemption from Responsibility: This release includes, but is not limited to, injuries resulting from negligence, carelessness, or any other actions or omissions of the Facility or its staff.

V. Indemnification

• Agreement to Hold Harmless: The Patron agrees to indemnify and hold harmless the Facility, its owners, employees, agents, representatives, instructors, and volunteers from any liability, claims, demands, actions, and causes of action arising out of or related to the Patron's participation in the activities provided by the Facility.

• Acceptance of Financial Responsibility: The Patron agrees to bear all costs, including legal fees, associated with any claims or actions brought against the Facility as a result of the Patron's participation in said activities.

VI. Photographic Release

• Permission for Use of Likeness: The Patron grants the Facility the right to take photographs and videos of them in connection with their participation in Facility activities.

• Scope of Authorization: The Patron authorizes the Facility to use and publish such photographs and videos for promotional purposes, including but not limited to, advertising materials, social media, and the Facility's website.

VII. Acknowledgment of Understanding

• Confirmation of Reading and Comprehension: The individual referred to as the Patron hereby confirms and verifies that they have thoroughly read and comprehensively grasped all the stipulations, conditions, terms, and provisions outlined within this Agreement that is being discussed.

• Acknowledgment of Voluntary Agreement: The Patron, by signing this Agreement, acknowledges and affirms, without any ambiguity, that they have made the decision to do so of their own free will, and that this decision was made voluntarily.

• Furthermore, the Patron wants it to be known that they were not swayed or influenced by any form of coercion, pressure, or enticement to sign this Agreement.
