Kids Gym Release Of Liability

This Release of Liability ("Release") is entered into this [EFFECTIVE DATE] by and between [Your Company Name] ("Gym") and the undersigned participant and the parent or legal guardian, if the participant is a minor ("Participant"), collectively referred to herein as "Parties."

I. Assumption of Risk

The Parties understand and acknowledge that the activities offered at the Gym involve inherent risks, including but not limited to, bodily injury, property damage, and emotional distress. These risks may arise from but are not limited to, the use of gym equipment, participation in fitness classes, and interaction with other participants.

II. Acknowledgement of Understanding

By signing this Release, the Parties acknowledge that they have read and understood the risks associated with the activities offered at Gym. The Parties understand that these risks cannot be eliminated, even with the implementation of safety measures.

III. Release of Liability

In consideration of being permitted to participate in activities at the Gym, the Parties hereby release, waive, discharge, and covenant not to sue the Gym, its owners, employees, instructors, volunteers, and affiliates from all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by the Participant while participating in activities at Gym.

IV. Indemnification

The Parties agree to indemnify, defend, and hold harmless the Gym, its owners, employees, instructors, volunteers, and affiliates from and against any claims, suits, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to the Participant's participation in activities at Gym.

V. Emergency Medical Treatment

In the event of any injury or illness to the Participant, the Parties authorize the Gym to obtain emergency medical treatment for the Participant as deemed necessary. The Parties agree to be responsible for any expenses incurred for such treatment.

VI. Parental Responsibility

The undersigned parent or legal guardian acknowledges that they are solely responsible for the supervision and well-being of the Participant while on the premises of the Gym. The parent or legal guardian agrees to ensure that the Participant follows all rules and instructions provided by the Gym.

VII. Photography and Video Release

The Parties consent to the Gym's use of photographs, videos, or other media depicting the Participant for promotional purposes without compensation or further consent.

VIII. Governing Law

This Release shall be governed by and construed by the laws of [State/Country], without regard to its conflict of laws principles.

IX. Severability

If any provision of this Release is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

X. Entire Agreement

This Release constitutes the entire agreement between the Parties concerning the subject matter hereof and supersedes all prior and contemporaneous agreements and understandings, whether written or oral.

XI. Execution

By signing below, the Parties acknowledge that they have carefully read and fully understand all the provisions of this Release, and voluntarily agree to be bound by its terms.
