North Carolina Will
North Carolina Will
I. DECLARATION
I, [YOUR NAME], of 456 Maple Avenue, Charlotte, NC, born on March 15, 2055, being of sound mind and memory, do hereby declare this document to be my last will. I revoke all Wills and Codicils previously made by me.
II. EXECUTOR APPOINTMENT
I appoint Benjamin Clark, currently residing at 123 Main Street, Raleigh, NC, as the executor ("Executor") of this Will. If Benjamin Clark is unable or unwilling to serve, I appoint Amelia Wright as the alternate Executor.
III. ASSETS AND LIABILITIES
A. Real Property
-
I bequeath my quaint cottage located at 789 Oak Street, Raleigh, NC to my niece, Sophie Johnson.
-
Any remaining real property shall be equally divided among my surviving children: Ethan Johnson, Olivia Johnson, and Lucas Johnson.
B. Personal Property
-
I direct the distribution of my treasured collection of antique books as follows:
-
"Pride and Prejudice" to Olivia Johnson
-
"To Kill a Mockingbird" to Lucas Johnson
-
"1984" to Ethan Johnson
-
-
All personal property that I own, aside from the items and assets that have been explicitly mentioned in other sections of my will, shall be liquidated through a process of being sold. Any proceeds that result from the sale of said personal property shall then be accumulated and added to my residuary estate, which is the portion of my estate that remains after debts, charges, expenses, and specific legacies have been paid or accounted for.
IV. SPECIFIC BEQUESTS
I make the following specific bequests:
-
My diamond necklace: To my sister, Grace Lewis.
-
My vintage record player: To my nephew, Noah Johnson.
V. RESIDUARY ESTATE
I hereby declare that my desire and instruction is to bequeath all of the remaining parts and elements of my estate - regardless of their current location or nature, and taking into account both real estate and personal belongings - to The Johnson Family Trust. These remaining parts and elements of my estate are those that stand after accounting for any other specific bequests I may have detailed elsewhere. This constitutes the entirety of the rest, residue, and remainder of my estate.
VI. GUARDIANSHIP
If any of my children are still considered minors at the time when I pass away, it is my wish and direction that my sister, Grace Lewis be appointed as their official legal guardian. This is to allow them to be cared for and their legal matters handled with their best interests at heart. However, should the circumstance arise where my sister, Grace Lewis is incapable of fulfilling this responsibility or if she doesn't wish to accept this role, it is then my secondary plan that my brother, Henry Johnson be the alternate to step in as their guardian. His duty will be to undertake the role and functionality of their legal guardian, ensuring their needs and welfare are well taken care of.
VII. FUNERAL AND BURIAL INSTRUCTIONS
It is my express request that the individual whom I have appointed as my Executor take the necessary steps to organize a simple funeral service and proper burial on my behalf. I have full confidence in their ability and judgment and hence leave the precise details of the arrangements related to the service and burial within their autonomous discretion and consideration.
VIII. MISCELLANEOUS PROVISIONS
A. No Contest Clause
I hereby declare that if any beneficiary under this Will contests the validity of this Will or any of its provisions, any share or interest in my estate given to that contesting beneficiary is revoked, and such share or interest shall be added to the residuary estate.
B. Governing Law
This Will shall be governed by and construed under the laws of the State of North Carolina.
C. Severability
If any provision of this Will is held to be invalid or unenforceable, the remaining provisions shall nevertheless continue in full force without being impaired or invalidated in any way.
IN WITNESS WHEREOF, I, [YOUR NAME], the testator, have to this will set my hand this 15th day of August, 2055, in the presence of the undersigned witnesses, who witnessed and subscribed this will at my request, and in my presence.
