1. Payment Terms

In order to secure the comprehensive travel services provided by the Agency, the Client agrees to adhere to the following detailed payment structure:

  • Initial Deposit: The Client is required to pay an initial deposit of 50% of the total estimated cost immediately upon signing this Agreement. This deposit guarantees the reservation and allows the Agency to begin making necessary bookings with airlines, hotels, and other service providers.

  • Final Payment: The remaining 50% of the travel cost must be settled at least 30 days prior to the start of the travel. This ensures that all services are paid in full and confirms all reservations in the Client's itinerary.

  • Payment Methods: Payments can be made through several secure methods:

    • Credit Card: For immediate processing and confirmation.

    • Bank Transfer: Recommended for direct deposits from bank accounts, might require additional processing time.

    • Check: Acceptable for clients who prefer traditional payment methods; must be cleared before final booking confirmation.

  • Payment Instructions: Detailed payment instructions, including bank details for transfers, mailing address for checks, and a secure link for credit card payments, will be provided by the Agency upon the signing of this Agreement.

2. Cancellation and Refunds

The cancellation policy is structured to provide clarity and fairness to both parties involved, recognizing the costs incurred in planning and booking travel services:

  • Cancellation Notification: The Client must submit a written cancellation notice to the Agency no later than 45 days prior to the scheduled departure date to qualify for a partial refund.

  • Refund Policy: If the Client cancels within the stipulated timeframe, they will receive a refund of 75% of the total payments made. This acknowledges the administrative and reservation costs already incurred by the Agency.

  • No Refund for Late Cancellations: Cancellations made less than 45 days before departure will not be eligible for any refund, as most costs by then are non-recoverable commitments made to service providers.

  • Agency-Initiated Cancellations: If the Agency must cancel the travel services for reasons such as insufficient participants or unforeseen operational challenges, the Client will be entitled to a full refund of all payments made without any deductions.

3. Changes in Pricing

Given the dynamic nature of travel pricing, the following terms apply to any necessary adjustments:

  • Causes for Price Adjustments: Changes in the cost of travel services can occur due to unforeseen variations in exchange rates, sudden changes in airfares, and modifications in supplier costs.

  • Notification of Changes: The Agency commits to notifying the Client of any price increases or decreases as soon as they are apparent. This allows the Client to make informed decisions about their travel plans.

  • Client's Options: Upon notification of a price adjustment, the Client will have the option to:

    • Accept the new price and proceed with the booking.

    • Cancel the booking and receive a full refund, thereby avoiding the increased costs.

4. Late Payment Penalties

To ensure timely processing and to discourage delays in payment, the following penalties will apply:

  • Late Payment Fee: A monthly penalty of 2% of the outstanding balance will be applied for payments not received by the due date.

  • Effect of Non-Payment: If payment is delayed by more than 60 days, the Agency reserves the right to:

    • Cancel the reservation.

    • Apply the cancellation policy as previously detailed, including the forfeiture of any deposits or payments made.

  • Communication and Reminders: The Agency will send reminders via email and, if necessary, by phone, to ensure the Client is aware of upcoming payment deadlines. This is to help avoid penalties and potential cancellation due to non-payment.

5. Client Responsibilities

To ensure a smooth and efficient travel experience, the Client is required to adhere to the following responsibilities:

  • Provision of Accurate Information: The Client must provide accurate and complete information necessary for booking travel services. This includes, but is not limited to, full legal names as per passport, date of birth, passport numbers, special accommodation needs, and preferences concerning travel arrangements.

  • Compliance with Travel Advisories: The Client is responsible for staying informed about and complying with the travel advisories issued by governmental or international authorities relevant to the destination(s).

  • Health and Safety: The Client must ensure that they meet all health entry requirements, receive necessary vaccinations, and follow safety guidelines as advised for the destinations. The Agency will provide guidance but the ultimate responsibility lies with the Client.

  • Travel Documentation: The Client is responsible for obtaining all necessary travel documents, including passports, visas, or other required travel authorizations. The Client should ensure that all documents are valid and cover the duration of the trip.

  • Communication: The Client must maintain open and timely communication with the Agency, especially if there are changes in their travel plans or personal circumstances that could affect their travel arrangements.

6. Insurance and Liability

Understanding the uncertainties associated with travel, the following terms regarding insurance and liability are established:

  • Travel Insurance: The Client is strongly encouraged to purchase comprehensive travel insurance that covers trip cancellations, medical expenses, loss of luggage, and other potential travel disruptions. The Agency can assist in facilitating this insurance through reputable providers but the final choice and agreement lie with the Client.

  • Agency Liability: The Agency acts only as an agent for the providers of air, sea, rail, automobile, hotel, and other services. As such, the Agency shall not be held liable for any loss, injury, accident, damage, delay, or inconvenience caused by any default or negligence of any company or person engaged in providing these services.

  • Limitations of Liability: The Agency's liability for any claim arising out of or relating to the travel services shall be limited to the fee paid by the Client for such services. Under no circumstances will the Agency be liable for indirect, special, or consequential damages.

  • Indemnification: The Client agrees to indemnify and hold harmless the Agency from and against any claims, demands, liabilities, costs, or expenses, including reasonable legal fees, arising from or related to any breach by the Client of any of the terms of this Agreement or from any negligence or wrongful act by the Client.

7. Legal and Miscellaneous
