Salon Employment Agreement
This Salon Employment Agreement ("Agreement") is made effective as of [Date], by and between [Your Company Name] located at [Your Company Address] ("Employer"), and [Employee Name], residing at [Employee Address] ("Employee").
WHEREAS, Employer operates a professional salon providing hair styling, beauty treatments, and related services;
WHEREAS, Employer wishes to employ Employee in the capacity of [Job Title], and Employee wishes to accept such employment under the terms and conditions set forth herein;
NOW, THEREFORE, in consideration of the mutual promises and agreements contained herein, the parties agree to be legally bound as follows:
I. Position and Duties
A. Job Title: Employee is hired in the capacity of [Job Title].
B. Primary Duties: Employee shall perform hair cutting, styling, coloring, and other beauty services as required. Additionally, Employee is responsible for maintaining their work area, managing their appointments, and ensuring client satisfaction.
C. Additional Responsibilities: Employee may be required to participate in training sessions, assist with inventory management, and contribute to promotional events hosted by the salon.
II. Term of Employment
A. Commencement: This Agreement shall commence on [Start Date] and continue until terminated as provided herein.
B. At-Will Employment: Employment under this Agreement is "at-will," meaning either the Employer or the Employee can terminate the employment relationship at any time, for any reason or for no reason, with or without notice.
III. Compensation and Benefits
A. Salary: Employee will receive a base salary of $3,000 per month, payable bi-weekly.
B. Commissions: Employee will earn a commission of 10% on all personal service revenues exceeding $5,000 per month.
C. Bonuses: Employee is eligible for an annual performance bonus of up to 5% of the total annual personal service revenues, based on achievement of specific performance targets set at the beginning of each fiscal year.
D. Benefits: Employee will be eligible for the following benefits after a 90-day probationary period:

Health insurance, with 50% of the premium paid by Employer.

Two weeks of paid vacation annually.

Five paid sick days per year.
IV. Work Schedule
A. Regular Hours: Employee is expected to work a minimum of 40 hours per week. The typical work schedule is from 9:00 AM to 5:00 PM, Tuesday through Saturday.
B. Overtime: Any hours worked beyond the standard 40 hours per week will be considered overtime. Overtime must be approved in advance by the Employer and will be compensated at one and a half times the regular hourly rate.
V. Performance Evaluation
A. Regular Reviews: Employee's performance will be evaluated formally twice a year to assess the fulfillment of assigned duties, client satisfaction, and overall contribution to the salon.
B. Evaluation Criteria: The evaluations will consider client retention rates, revenue generated, professionalism, teamwork, and adherence to salon policies.
C. Outcome of Evaluations: Based on performance evaluations, decisions regarding salary adjustments, potential promotions, or any necessary corrective actions will be made. Satisfactory evaluations may result in merit increases, which are at the discretion of the Employer.
VI. Confidentiality Agreement
A. Non-Disclosure of Confidential Information: Employee agrees not to disclose any confidential information related to the salon’s operations, client details, or proprietary processes during and after the term of employment without prior written consent from the Employer.
B. Duration of Confidentiality: This confidentiality obligation shall continue indefinitely beyond the termination of employment, regardless of the reason for termination.
VII. Non-Compete Clause
A. Restriction on Competition: Upon termination of employment, Employee agrees not to engage in or start a business that directly competes with the Employer within a 5-mile radius of the salon for a period of one year.
B. Non-Solicitation: Employee shall not solicit the salon's clients or employees for their personal benefit or for the benefit of others during and for two years following the termination of employment.
VIII. Termination Conditions
A. Voluntary Termination: Employee may terminate this Agreement at any time by providing 14 days' written notice to the Employer.
B. Involuntary Termination: Employer may terminate this Agreement immediately for cause, including but not limited to, gross misconduct, violation of salon policies, or failure to perform job duties satisfactorily.
C. Notice Period: In cases of termination for reasons other than cause, Employer will provide Employee with a 14-day notice or, at Employer’s discretion, payment in lieu of notice.
IX. Dispute Resolution
A. Mediation: In the event of a dispute arising from this Agreement, both parties agree to first attempt to resolve the matter through mediation with a mutually agreed-upon mediator.
B. Arbitration: If mediation fails to resolve the dispute, the matter will proceed to binding arbitration in accordance with the rules of the American Arbitration Association.
X. Miscellaneous Provisions
A. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the state where the salon is located.
B. Amendment: Any amendments or modifications to this Agreement must be made in writing and signed by both parties.
C. Severability: If any part of this Agreement is found to be invalid or unenforceable, the remaining parts will continue to be valid and enforceable.
