Recitals

1. Lease Premises

The Lessee must also address any damage caused directly by its employees, guests, or patrons promptly and to a standard that maintains the property’s quality and compliance with health and safety standards.

6. Utilities

The Lessee will assume financial responsibility for all utilities associated with the property, including water, electricity, gas, internet, and telephone services. This arrangement requires the Lessee to establish accounts with utility providers and manage payments directly, ensuring uninterrupted service essential for hotel operations.

7. Insurance

7.1 Liability Insurance

The Lessee shall procure and maintain comprehensive general liability insurance to cover potential claims of bodily injury or property damage related to the hotel’s operations. This insurance protects both the Lessee and the Lessor from significant financial loss and legal liabilities.

7.2 Property Insurance

Additionally, the Lessee is required to secure property insurance that covers all movable property and equipment within the Leased Premises. This coverage should reflect the full replacement value of the contents and include the Lessor as an additional insured party, providing further financial protection against loss or damage.

8. Indemnification

The Lessee agrees to indemnify and hold the Lessor harmless from any losses, expenses, damages, and liabilities, including legal fees, that arise from the Lessee’s operation of the hotel. This indemnification extends to claims made by third parties, including guests and employees, and covers incidents occurring within the Leased Premises and areas under the control of the Lessee, reinforcing the Lessee’s responsibility for maintaining a safe and compliant operation.

9. Default

9.1 Notice of Default

In the event of default by either Party, the non-defaulting Party shall give written notice to the defaulting Party specifying the nature of the default.
