This release of liability is encompassing and applies without limitation, except in specific instances where gross negligence or willful misconduct on the part of the Spa, its owners, employees, or affiliates can be proven.

Moreover, both parties to this Contract expressly agree to work together in good faith to replace the identified invalid or unenforceable provision with a new provision. This new provision shall be both valid and enforceable, and shall most closely approximate the original intent and economic effect of the invalid or unenforceable provision to the maximum extent permitted by applicable law.
