Cafe Working Agreement
This Cafe Working Agreement (the "Agreement") is entered into on [Date], by and between [Your Company Name], located at [Your Company Address], hereinafter referred to as the "Employer," and [Employee Name], residing at [Employee Address], hereinafter referred to as the "Employee."
The Employer desires to employ the Employee as a Barista and the Employee agrees to accept such employment under the terms and conditions set forth in this Agreement. This Agreement shall govern the relationship between the parties and shall be binding upon them, their heirs, successors, and assigns.
I. Employment Details
A. Job Title and Description: The Employee shall be employed as a Barista. The duties and responsibilities of the Employee shall include, but are not limited to, preparing and serving beverages, operating cash registers, and maintaining cleanliness in the cafe.
B. Work Schedule: The Employee's work schedule shall consist of five (5) days per week, with eight (8) hours of work per day. The specific work schedule shall be determined by the Employer and may be subject to change with reasonable notice.
C. Location of Work: The Employee's primary place of work shall be at [Your Company Address]. The Employee may be required to work at other locations as deemed necessary by the Employer.
D. Duration of Employment: The employment of the Employee shall be permanent in nature, commencing on the date of hire and continuing until terminated by either party in accordance with the terms of this Agreement.
E. Probationary Period: The Employee's initial employment shall be subject to a probationary period of thirty (30) days, during which time the Employee's performance shall be evaluated. The probationary period may be extended at the discretion of the Employer.
F. Compensation Details: The Employee shall be paid a wage of $15.00 per hour, with payment made on the 1st and 15th of each month via direct deposit.
G. Benefits: The Employee shall be entitled to the following benefits: health insurance, retirement plan, and paid time off. The specifics of these benefits shall be governed by the policies and procedures established by the Employer.
II. Duties and Responsibilities
A. Employee's Duties: The Employee's duties shall include, but are not limited to, the following:
Greeting and serving customers in a friendly and efficient manner.
Taking customer orders and processing payments accurately.
Preparing and serving beverages and food items according to the cafe's standards.
Maintaining cleanliness and organization in the cafe, including cleaning tables and work areas.
Following all health and safety guidelines and procedures.
Assisting other team members as needed.
B. Employer's Expectations: The Employer expects the Employee to:
Arrive on time for scheduled shifts and adhere to the agreed-upon work schedule.
Maintain a professional appearance and demeanor at all times.
Communicate effectively with customers and coworkers.
Follow all company policies and procedures.
Participate in training and development opportunities as required.
C. Standards of Conduct and Professionalism: The Employee is expected to adhere to high standards of conduct and professionalism, including:
Treating all customers and coworkers with respect and courtesy.
Resolving customer complaints or issues promptly and effectively.
Maintaining confidentiality of customer and company information.
Adhering to all applicable laws and regulations.
III. Working Conditions
A. Workplace Environment: The workplace environment at the cafe is fast-paced and may be noisy at times. The Employee will be required to stand for extended periods and work in close proximity to others.
B. Health and Safety Regulations: The Employer is committed to providing a safe and healthy workplace. The Employee is expected to comply with all health and safety regulations, including wearing appropriate attire and following proper procedures for handling food and beverages.
C. Equipment and Tools Provided: The Employer will provide the Employee with the necessary equipment and tools to perform their duties, including a uniform and any required safety gear.
D. Break and Meal Periods: The Employee will be entitled to a break of [Number of Minutes] minutes for every [Number of Hours] hours worked, as required by law.
E. Overtime Policy: If the Employee is required to work overtime, they will be compensated at a rate of one and a half times their regular hourly wage for all hours worked in excess of [Number of Hours] hours per week.
IV. Confidentiality
Both parties agree to maintain the confidentiality of any proprietary or confidential information belonging to the other party. This includes, but is not limited to, customer information, business strategies, and financial information. The Employee shall not disclose such information to any third party without the written consent of the Employer.
V. Termination of Employment
Either party may terminate this Agreement at any time, with or without cause, by providing [Number of Days] days' notice in writing. In the event of termination, the Employee shall be entitled to receive payment for any accrued but unused vacation days and any other compensation due up to the date of termination.
VI. Dispute Resolution
Any disputes arising out of or relating to this Agreement shall be resolved through mediation. If mediation is unsuccessful, the parties agree to submit the dispute to binding arbitration in accordance with the rules of the American Arbitration Association. The decision of the arbitrator(s) shall be final and binding on both parties.
VII. Amendments and Modifications
This Agreement may be amended or modified only by a written agreement signed by both parties. Any amendments or modifications shall be effective as of the date of the written agreement.
