2. Compensation and Benefits

5. Confidentiality

The Employee acknowledges that during the course of employment, they may have access to confidential and proprietary information, including but not limited to recipes, customer lists, and business strategies (hereinafter referred to as "Confidential Information").
5.2 Non-Disclosure
The Employee hereby agrees and commits to abstain from disclosing, utilizing, or allowing the utilization of any Confidential Information for any purpose other than the specific performance of their responsibilities and duties associated with their role for the Employer. This obligation to maintain the confidentiality and restricted use of such information shall remain in effect and continue to be binding even after the termination of this Contract.
6. Non-Compete and Non-Solicitation
6.1 Non-Compete
During the term of employment and for a period of [Number] months following the termination of this Contract, the Employee shall not, directly or indirectly, engage in any business that competes with the Employer within a [Number]-mile radius of the cafe.
6.2 Non-Solicitation
During the term of employment and for a period of [Number] months following the termination of this Contract, the Employee shall not, directly or indirectly, solicit or attempt to solicit any customers or employees of the Employer for the purpose of engaging in a competing business.
7. Workplace Policies
7.1 Code of Conduct
The Employee hereby agrees to adhere to, comply with, and follow all workplace policies and procedures that have been, and may in the future be, established and instituted by the Employer. This includes but is not limited to, the comprehensive set of behavioral guidelines outlined in the Code of Conduct, the specific expectations and rules regarding appropriate attire as detailed in the Dress Code, and all regulations, standards, and practices stipulated in the Health and Safety Policies to ensure a secure and safe working environment.
7.2 Disciplinary Actions
The Employer retains the authority to initiate and carry out disciplinary actions in response to any infractions of established workplace policies or instances of inadequate job performance. These disciplinary measures may range in severity and can include, but are not limited to, terminating the employment of the individual found to be in violation or underperforming.
8. Miscellaneous Provisions
8.1 Entire Agreement
This Contract represents the complete and comprehensive agreement between the parties involved, and it overrides and replaces any and all previous agreements, understandings, and representations made by the parties, regardless of whether those were communicated verbally or documented in writing.
8.2 Amendments
Any amendments or modifications to this Contract must be documented in a written format and must be duly signed by both parties involved.
8.3 Governing Law
This Contract shall be governed by, construed in accordance with, and interpreted under the laws and statutes of the state of [State].
8.4 Severability
