4.5 Compliance: The Parent(s) agree to comply with any additional requirements set forth by the School or state regulations regarding the monitoring and reporting of the Student's attendance and academic progress. 5. Duration and Termination
5.1 Duration: This Agreement shall remain in effect for the duration of the academic year, beginning on [Month Day, Year] and ending on [Month Day, Year], unless terminated earlier by mutual agreement of the parties. The academic year typically aligns with the School’s calendar but can be adjusted based on the specific needs and agreement between the School and the Parent(s).
5.2 Early Termination: Either party may terminate this Agreement before the end of the academic year upon written notice to the other party. The terminating party must provide at least [0] days' notice in writing. This notice period allows sufficient time for the Student to transition to a new educational setting or for the School to make necessary adjustments.
5.3 Mutual Agreement: The Agreement may also be terminated at any time by mutual written consent of both the School and the Parent(s). This provision allows for flexibility if both parties agree that homeschooling is no longer the best educational option for the Student.
5.4 Grounds for Termination by School: The School may terminate this Agreement if the Parent(s) fail to comply with the terms of this Agreement, including but not limited to inadequate record keeping, insufficient academic progress, or failure to adhere to the agreed-upon curriculum. The School must provide written notice specifying the reasons for termination and allow the Parent(s) an opportunity to rectify the situation within [0] days.
5.5 Grounds for Termination by Parent(s): The Parent(s) may terminate this Agreement if they believe that the School is not providing the necessary support or resources as outlined in this Agreement. The Parent(s) must provide written notice specifying their concerns and allow the School an opportunity to address these issues within [0] days.
5.6 Transition Plan: Upon termination of this Agreement, both parties agree to work together to ensure a smooth transition for the Student. This may include providing records of the Student's academic progress to a new school or educational authority, coordinating the transfer of educational materials, and supporting the Student in adjusting to a new learning environment.
6. Governing Law
6.1 Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of the State of [State]. The laws of [State] shall be used to interpret and enforce this Agreement, and any legal proceedings arising out of this Agreement shall be brought in the appropriate courts located within [State].
6.2 Conflict of Law Principles: This Agreement explicitly disregards conflict of law principles. This means that even if there is a dispute about which state’s law should apply, the laws of [Your State] will govern, without considering the laws of any other jurisdiction that might otherwise apply due to the parties' locations or other factors.
6.3 Compliance with State Laws: The Parent(s) and the School agree to comply with all applicable state laws and regulations pertaining to homeschooling. This includes but is not limited to requirements for record keeping, curriculum standards, assessment and evaluation procedures, and notification requirements to local or state educational authorities.
6.4 Amendments and Modifications: Any amendments or modifications to this Agreement must be in writing and signed by both parties. Such amendments or modifications must also comply with the governing laws of [State] to be valid and enforceable.
