This School Tuition Contract Template (“Contract”) is entered into effect as of [Month Day, Year] ("Effective Date"), by and between [Your Company Name] (“School”), an educational institution existing under the laws of [State], with its principal place of business at [Your Company Address], and [Student’s Name] (“Student”), a student of [Your Company Name], collectively known as "Parties".

I. Tuition Agreement

  1. Scope of Educational Services: The School agrees to provide the Student with access to educational programs, facilities, and resources for the specified academic term. This includes, but is not limited to, classroom instruction, academic support services, and extracurricular activities as deemed appropriate by the School.

  2. Duration of Enrollment: The Student's enrollment in the School is valid for the duration of the academic term specified in this Contract. Upon completion of the term, the Student may renew their enrollment for subsequent terms subject to the School's policies and procedures.

  3. Curriculum and Course Offerings: The School reserves the right to determine the curriculum and course offerings for each academic term. The Student agrees to comply with the academic requirements and standards established by the School, including the completion of required coursework and assessments.

II. Payment Terms

  1. Due Date for Tuition Payment: Tuition fees are due in full prior to the commencement of classes for the academic term. The Student or their legal guardian is responsible for ensuring that payment is made by the specified due date, as outlined in the School's billing schedule.

  2. Accepted Payment Methods: The School accepts payment for tuition fees by check, bank transfer, credit card, or other methods approved by the School's administration. Payments must be made in the currency specified by the School and may be subject to processing fees or currency conversion charges.

  3. Installment Payment Plans: The School may offer installment payment plans for tuition fees upon request. Any such installment plans must be approved by the School's administration and adhere to the payment schedule and terms agreed upon by both parties.

III. Late Payment Penalty

  1. Penalty for Late Payment: In the event of late payment, a penalty fee will be assessed on the outstanding balance. The penalty fee amount and applicable grace period for late payment shall be specified in the School's billing policies and communicated to the Student or their legal guardian at the time of enrollment.

  2. Impact on Enrollment Status: Failure to pay tuition fees by the specified due date may result in the Student being placed on academic probation or suspended from classes until payment is received. The School reserves the right to withhold services and privileges, including access to academic records and participation in extracurricular activities, until all outstanding fees are settled.

  3. Collection Procedures: The School may pursue collection actions to recover unpaid tuition fees, including but not limited to sending past-due notices, engaging collection agencies, and initiating legal proceedings. The Student or their legal guardian is responsible for any costs associated with debt collection.

IV. Refund Policy

  1. Withdrawal Prior to Start of Term: If the Student withdraws from the School prior to the start of classes for the academic term, a refund of tuition fees may be granted upon written request. The amount of the refund, if any, shall be determined by the School's refund policy and applicable administrative fees.

  2. Refund Eligibility: To be eligible for a refund, the Student must submit a written withdrawal request to the School's administration and comply with any additional requirements specified in the School's refund policy. Failure to adhere to the School's withdrawal procedures may result in forfeiture of refund eligibility.

  3. Refund Processing Time: Refunds of tuition fees will be processed within a reasonable timeframe following receipt of a valid withdrawal request. The School reserves the right to withhold refunds until all outstanding charges and fees owed to the School have been settled by the Student or their legal guardian.

V. Termination of Contract

  1. By the School

    • The School reserves the right to terminate this contract if the Party fails to meet the tuition amount by the due dates or if the Student violates any of the school’s policies.

    • Violation of School policies may be argued and/or negotiated for if certain circumstances prevented the Student from adhering to them. This will be done in front of the school board, a government representative, and any other involved individuals.

  2. By the Party

    • The Party may terminate this contract by providing a notice via the school’s email fifteen (15) days in advance.

    • A discussion with the school board will be done in order to discuss the reason for the termination of contract, whereby the talk for refund and honorable discharge can be done.

VI. Liability and Indemnification

  1. General Disclaimer: The School, which includes the school board and board of directors, administrators, faculty, staff, and employees, shall not be liable for any loss, damage, injury, or harm of any kind that may occur to the Student or the Student’s property while on School premises or during any School-related activities, whether caused by negligence or otherwise, except in cases of gross negligence or willful misconduct by the School itself.

  2. Indemnification: The Party agrees to indemnify, defend, and hold harmless the School from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees and costs, arising out of or in any way connected with the Student's enrollment or participation in any School activities, including but not limited to claims arising from the Student's own actions, the actions of other students, or the actions of third parties.

  3. Governing Law: This Contract shall be governed by and construed in accordance with the laws of the state in which the School is located, without regard to its conflict of laws principles. Any disputes arising under this Contract shall be resolved in the state or federal courts located in the School's jurisdiction.

  4. Force Majeure: The School shall not be liable for any failure or delay in performing its obligations under this Contract due to causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, pandemics, government orders, or natural disasters.

  5. Behavioral Expectations and Disciplinary Actions: The Party acknowledges that the Student is subject to the School's Code of Conduct and disciplinary policies. The School shall not be liable for any claims arising from disciplinary actions taken in accordance with these policies.

VII. Amendments

Any amendments to this contract must be made in writing and signed by both parties.

  1. Right to Amend: The School reserves the right to amend, modify, or update the terms and conditions of this Contract, including but not limited to tuition fees, policies, procedures, and rules, at any time and from time to time. Such amendments shall be effective upon notice to the Party as described herein.

  2. Notification of Amendments: The School will provide written notice of any amendments to this Contract via email, postal mail, or through the School's official website or parent portal. The Party agrees to regularly check these communication channels for updates

  3. Annual Review: The School shall conduct an annual review of the Contract and may make necessary amendments at the beginning of each academic year. The Party will be notified of any such amendments before the start of the new school year.

VIII. Agreement

By enrolling the Student in the School, the Party acknowledges that they have read, understood, and agree to the terms and conditions of this Contract. The Party then further acknowledges that this Contract has been negotiated and agreed upon as a material part of the enrollment Contract.
