1. Introduction
This Photography Client Contract ("Contract") is made effective as of [Date] by and between [Your Name], ("Photographer") and [Client's Name], ("Client"). This Contract outlines the terms and conditions under which the Photographer will provide photography services to the Client.
2. Services Provided
The Photographer agrees to provide the following services to the Client: portrait photography session. The services will be provided on [Date], at [Location].
3. Payment Terms
The Client agrees to pay the Photographer the total sum of [Amount], payable as follows: [Amount] as a non-refundable deposit due on [Date] and the remaining balance of [Amount] due on [Date].
4. Cancellation Policy
If the Client chooses to cancel this Contract, the Client must notify the Photographer in writing. Any cancellations made less than 14 days before the scheduled services will result in the forfeiture of any payments made.
5. Image Usage and Rights
The Photographer retains the copyright to all images produced and reserves the right to use the images for portfolio, website, social media, and promotional purposes. The Client receives limited usage rights for personal use and may not sell or distribute the images for profit.
6. Liability
The Photographer will take all reasonable steps to ensure high-quality images; however, in the unlikely event of equipment failure, photographer illness, or other unforeseen issues, the Photographer's liability is limited to the return of all payments received. The Photographer will not be liable for any damages, including but not limited to digital files or prints damaged during post-processing and/or printing.
7. Model Release
The Client grants the Photographer the irrevocable and unrestricted right to use and publish photographs of the Client or in which the Client may be included for editorial, trade, advertising, and any other purpose in any manner and medium.
8. Entire Agreement
This Contract represents the entire agreement between the Photographer and the Client. No alterations or additions to this Contract, including provisions contained in any purchase order, check, or other instrument, shall be effective unless in writing and signed by both parties.
9. Severability
If any provision of this Contract is found to be invalid or unenforceable by a court of competent jurisdiction, all remaining provisions of this Contract shall remain in full force and effect.
10. Governing Law
This Contract shall be governed by and construed in accordance with the laws of [State].
