I. Warranty Coverage

This Standard Construction Warranty ("Warranty") is provided by [YOUR COMPANY NAME] ("Contractor") to Kelly Meyers ("Owner") for the residential construction project located at 194 Oakville Road, Phoenix, Arizona ("Property"). This Warranty guarantees that the construction work performed by the Contractor will be free from major defects in workmanship or materials for a period of one year from the date of completion.

II. Scope of Warranty

This Warranty covers defects arising from:

  • Faulty workmanship

  • Defective materials used in the construction

  • Structural issues affecting the integrity of the Property

The Warranty does not cover:

  • Normal wear and tear

  • Damage resulting from accidents, misuse, or neglect

  • Conditions arising from Owner’s failure to maintain the Property

III. Warranty Period

IV. Claims Procedure

To file a claim under this Warranty, the Owner must:

  1. Notify the Contractor in writing of the defect within the Warranty period.

  2. Provide a detailed description of the defect, including photographs if possible.

  3. Allow the Contractor access to the Property to inspect the defect.

Upon receipt of a valid claim, the Contractor will:

  1. Inspect the Property to verify the defect.

  2. Determine whether the defect is covered under the Warranty.

  3. Undertake necessary repairs or replacements as required.

V. Contractor's Obligation

Upon confirmation of a valid claim, the Contractor will:

  1. Repair or replace defective workmanship or materials at no cost to the Owner.

  2. Complete the repair work within a reasonable time frame, subject to the availability of materials and scheduling constraints.

Limitations and Exclusions

This Warranty is the sole and exclusive remedy for defects in workmanship or materials. The Contractor will not be liable for any consequential or incidental damages arising from defects. Any verbal or written statements made by the Contractor or its representatives beyond the scope of this Warranty are not binding.

VI. Transferability

This Warranty is transferable to subsequent owners of the Property during the Warranty period, provided that the new owner notifies the Contractor of the transfer in writing.

VII. Governing Law

This Warranty shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law principles.
