Release of Liability for Property Damage


This Release of Liability (hereinafter referred to as the "Release") is made and entered into on this 1st day of September 2055, by and between:

RECITALS

WHEREAS, the Releasor desires to release the Releasee from any and all liability, claims, demands, and causes of action that may arise in connection with the property damage sustained by the Releasor; and

WHEREAS, the Releasor acknowledges that the Releasee is not responsible or liable for any property damage, and the Releasor desires to release the Releasee from any liability related to the property damage;

NOW, THEREFORE, in consideration of the mutual covenants and promises set forth herein, the Releasor and Releasee hereby agree as follows:

1. Release of Liability

The Releasor, on behalf of themselves, their heirs, executors, administrators, and assigns, does hereby release, waive, and forever discharge the Releasee and its agents, employees, officers, and affiliates from any and all claims, demands, liabilities, damages, actions, or causes of action arising from or relating to any property damage sustained by the Releasor, whether known or unknown, which may occur as a result of the actions or omissions of the Releasee.

2. Acknowledgment of Risk

The Releasor acknowledges and understands that property damage may result from unforeseen incidents, accidents, or events. The Releasor agrees to assume full responsibility for any and all risks of damage to their property and expressly releases the Releasee from any liability associated with such damage.

3. No Admission of Liability

This Release does not constitute an admission of liability by the Releasee, and the Releasee denies any fault, wrongdoing, or liability for any property damage that may have occurred. This Release is entered into voluntarily by the Releasor and is intended to fully and finally resolve any and all disputes concerning property damage.

4. Indemnification

The Releasor agrees to indemnify, defend, and hold harmless the Releasee from any and all claims, damages, costs, expenses, and attorney’s fees that may arise as a result of any claim brought by the Releasor or a third party in connection with the property damage.

5. Governing Law

This Release shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes arising from or related to this Release shall be resolved in the state or federal courts located within California.

6. Entire Agreement

This Release constitutes the entire agreement between the parties with respect to the subject matter contained herein and supersedes any and all prior or contemporaneous understandings, agreements, or representations, whether oral or written.

7. Severability

If any provision of this Release is found to be invalid or unenforceable, such provision shall be severed from the remainder of the Release, and the remaining provisions shall continue in full force and effect.

8. Binding Effect

This Release shall be binding upon and inure to the benefit of the parties hereto and their respective heirs, executors, administrators, successors, and assigns.

9. Execution

The parties agree that this Release may be executed in counterparts, each of which shall be deemed an original, but all of which together shall constitute one and the same instrument.
