Rental Equipment Liability Waiver
RENTAL EQUIPMENT LIABILITY WAIVER
This Rental Equipment Liability Waiver (the "Waiver") is executed on this 10th day of August 2055, by and between [YOUR COMPANY NAME] (the "Provider") and Drake Feeney (the "Renter").
1. Acknowledgment of Risk
The Renter acknowledges and understands that the rental of equipment may involve certain risks, including but not limited to, physical injury, property damage, or even death. The Renter agrees to assume all risks associated with the use of the rented equipment.
2. Release of Liability
In consideration of being allowed to rent and use the equipment provided by [YOUR COMPANY NAME], the Renter hereby releases, waives, discharges, and covenants not to sue [YOUR COMPANY NAME], its officers, employees, agents, and assigns from any and all liabilities, claims, actions, damages, or losses arising out of or related to the use of the rented equipment, even if caused by the negligence of the Provider.
3. Indemnification
The Renter agrees to indemnify, defend, and hold harmless [YOUR COMPANY NAME] from any and all claims, losses, liabilities, damages, or expenses, including attorney's fees, arising out of or related to the use of the rented equipment, including but not limited to, any claims made by third parties.
4. Equipment Condition
The Renter certifies that they have inspected the equipment prior to use and that it is in good condition and suitable for their intended purpose. The Renter agrees to return the equipment in the same condition as received, normal wear and tear excepted.
5. Governing Law
This Waiver shall be governed by and construed in accordance with the laws of the State of Texas. Any legal action arising from this Waiver shall be brought in the courts of Austin County, Texas.
6. Severability
If any provision of this Waiver is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.
7. Acknowledgment of Understanding
By signing this Waiver, the Renter acknowledges that they have read and understood its contents, and agree to be bound by its terms.
