1. Purpose of the Waiver

This Employee Property Damage Waiver (“Waiver”) is designed to protect the Employee from liability for accidental damage to company property, including equipment, vehicles, and goods, while performing off-site services or deliveries as part of their job duties. The Employee acknowledges their responsibility to handle company assets with care and attention but will not be held financially liable for unintentional damage, as outlined below.

2. Definitions

  • Company Property: Any equipment, tools, vehicle, product, or item provided by the Company for use by the Employee while performing off-site services.

  • Accidental Damage: Any unintentional harm, breakage, or impairment to Company Property caused without neglect, misuse, or reckless behavior.

3. Scope of Coverage

This Waiver applies to all Company Property assigned to the Employee for the purpose of completing field service or delivery-related tasks, including but not limited to:

  • Company vehicles used for transportation or delivery purposes.

  • Tools, devices, and equipment required for field service activities.

  • Goods or products transported for delivery to clients or customers.

4. Conditions of Coverage

The Company agrees to waive liability for accidental damage under the following conditions:

  • The Employee is actively performing assigned job duties in a responsible and professional manner.

  • The damage occurred due to unforeseen or unintentional circumstances and was not due to Employee negligence, carelessness, or intentional misconduct.

  • The Employee reports the damage to their immediate supervisor as soon as possible, no later than 24 hours after the incident.

  • The Employee complies with all safety guidelines and protocols provided by the Company.

5. Exclusions

The following situations are not covered under this Waiver, and the Employee may be held liable for damages in such cases:

  • Damage caused by reckless driving, speeding, or other traffic violations.

  • Failure to follow Company’s operational or safety procedures.

  • Use of Company Property for personal or unauthorized purposes.

  • Damage resulting from deliberate actions or gross negligence.

6. Employee Acknowledgment and Agreement

By signing this Waiver, the Employee acknowledges and agrees to the following:

  • They have read and understood the terms of this Waiver.

  • They are responsible for the proper care of Company Property while performing field service or delivery tasks.

  • They will adhere to all Company policies and protocols regarding the handling and transportation of Company assets.

  • They understand that they may be held financially responsible for damages resulting from any of the excluded situations listed above.
