Australia Liability Waiver
AUSTRALIA LIABILITY WAIVER
This Liability Waiver (the "Waiver") is executed on this 31st day of October, 2055, by and between Outdoor Adventures Charlotte ("Company") and the undersigned participant ("Participant").
I. Acknowledgment of Risks
The Participant acknowledges that they are participating in activities offered by the Company, including but not limited to zip-lining, mountain biking, and team-building exercises, which may involve inherent risks, including but not limited to physical injury, property damage, and other unforeseen risks. The Participant understands that these activities may involve strenuous physical exertion and the possibility of falls, injuries, or other accidents.
II. Release of Liability
In consideration of the services provided by the Company, the Participant hereby releases, waives, discharges, and holds harmless the Company, its owners, employees, agents, and volunteers from any and all liability for any injury or damage to the Participant, including but not limited to those caused by the negligence of the Company, and including any injuries or damages that may occur as a result of the Participant's own actions or negligence.
III. Indemnification
The Participant agrees to indemnify and hold the Company harmless from any claims or damages arising from their participation in the activities, including any attorney's fees and costs incurred, and any claims made by third parties as a result of the Participant's actions or negligence.
IV. Governing Law
This Waiver shall be governed by and construed by the laws of the State of North Carolina. Any disputes arising from this Waiver shall be resolved in the courts located within Charlotte, NC 28202.
V. Acknowledgment of Understanding
The Participant acknowledges that they have read this Waiver, understand its terms, and sign it voluntarily. The Participant affirms that they are at least 18 years of age or have parental/guardian consent to participate in the activities.
