Professional Joint and Mutual Will

PROFESSIONAL JOINT AND MUTUAL WILL

Date: November 4, 2050

PARTIES:

  • Testator 1: Rocky Orn, residing at Denver, CO 80202

  • Testator 2: Jolie Cassin, Denver, CO 80202

1. INTRODUCTION

We, the undersigned Testators, declare this document to be our Joint and Mutual Will. This Will expresses our mutual wishes regarding the distribution of our estate upon the death of either or both of us.

2. REVOCATION OF PRIOR WILLS

  • Revocation Clause: This Joint and Mutual Will revokes all prior Wills and codicils made by either of us, whether made individually or jointly.

3. DECLARATIONS

  • We are of sound mind and body and are executing this Will freely and voluntarily.

  • We intend this Will to serve as our last testament, expressing our mutual desires for the distribution of our assets.

4. APPOINTMENT OF EXECUTOR

  • We hereby appoint Maria Turner of Colorado Springs, CO 80901 as the Executor of this Will.

  • In the event that Maria Turner is unable or unwilling to serve, we appoint Markus Pagac of Denver, CO 80202 as the alternate Executor.

5. DISTRIBUTION OF ASSETS

5.1 Upon the Death of the First Testator

  • Upon the death of the first of us to pass away, all assets and properties shall be transferred to the surviving Testator.

  • The surviving Testator shall have full control and management of the estate.

5.2 Upon the Death of the Surviving Testator

  • Upon the death of the surviving Testator, our assets shall be distributed as follows:

    1. To our daughter, Eunice Howe: 50% of the estate, including our family home located at Denver, CO 80202.

    2. To our son, Jay Fox: 50% of the estate, including our vacation property located at Atlanta, GA 30303.

  • If any named beneficiary predeceases us, their share shall be distributed equally among the remaining beneficiaries.

6. GUARDIANSHIP OF MINOR CHILDREN

  • If we have minor children at the time of our deaths, we appoint Lee Brooks of Colorado Springs, CO 80901 as the guardian of our minor children.

  • In the event that Lisa Turner is unable or unwilling to serve, we appoint Beth Wynn of Colorado Springs, CO 80901 as the alternate guardian.

7. SPECIAL PROVISIONS

  • Specific Bequests: We may specify any specific gifts or bequests to individuals or charities here:

    • Our family heirloom piano to our daughter, Eunice Howe.

    • $5,000 to the Springfield Animal Shelter.

  • Funeral Arrangements: Our funeral arrangements and wishes shall be as follows:

    • We wish to be cremated and have our ashes scattered at the beach in Miami, FL 33101.

8. MISCELLANEOUS PROVISIONS

  • Governing Law: This Will shall be governed by the laws of the State of Colorado.

  • Severability: If any provision of this Will is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

9. SIGNATURES

  • We, the undersigned Testators, hereby declare that we have read this Joint and Mutual Will, understood its contents, and signed it as our free and voluntary act.
