Texas Joint Will

TEXAS JOINT WILL

This Joint Last Will and Testament is made on this 16th day of March, 2065, by and between Dayton Rohan and Adelia Harber, hereinafter referred to as "Testators," who reside at Plano, TX 75023 State of Texas.

Article I: Declaration

We, Dayton Rohan and Adelia Harber, being of sound mind and disposing memory, do hereby make, publish, and declare this document to be our Joint Last Will and Testament, and hereby revoke all previous wills and codicils made by either of us.

Article II: Mutual Understanding

We declare that it is our intention that this will shall serve as a joint and mutual last will, and the terms herein are binding upon any and all successors, executors, and assigns from the date of our death.

Article III: Appointment of Executor

We nominate and appoint John Casper of Lincoln, NE 68501 as the Executor of this Will. If John Casper is unwilling or unable to serve as Executor, we nominate Berta Flatley of Reno, NV 89501 as the alternate Executor.

Duties of Executor

  • To pay out of our estate all of our just debts, funeral expenses, and the expenses of administration of this estate as soon as reasonably possible.

  • To manage and distribute our estate according to the terms of this Will.

Article IV: Disposition of Property

Shared Property

All jointly owned property should remain under joint ownership until the death of the surviving spouse.

Individual Property

Upon the death of one Testator, the surviving Testator shall receive all rights, titles, and interests in the property owned individually by the deceased Testator. Upon the death of the last Testator, the remaining estate shall be distributed as follows:

  1. To Javier Jacobs, residing at Madison, WI 53701, the following property: residential property.

  2. To Baby Bartell, residing at Jersey City, NJ 07302, the sum of dollars ($[125,000).

  3. To Alanis Durgan, residing at Chula Vista, CA 91909, the remainder of the estate.

Article V: Guardianship

In the event that both of us shall die leaving minor children, we nominate Emmy Green of Anchorage, AK 99501 as the guardian of the person and estate of such minor children.

Article VI: Simultaneous Death

If we both die simultaneously or under circumstances where it cannot be determined who predeceased the other, it is our will that this shall be the distribution of our estate:

  • One half (1/2) to Baby Bartell.

  • One half (1/2) to Javier Jacobs.

Article VII: General Provisions

The terms "Testator" and "Executor" used herein shall include their declared heirs, legal representatives, and assigns, where applicable, and any pronouns used herein shall include both the singular and the plural and include all genders.

Signatures

We, Dayton Rohan and Adelia Harber, the Testators, sign our names to this Will, this 16th day of March, 2065, and being first duly sworn, do hereby declare to the undersigned authority that we sign and execute this instrument as our joint and mutual Will and that we sign it willingly, and that we execute it as our free and voluntary act for the purposes therein expressed, and that each Testator is eighteen (18) years of age or older, of sound mind, and under no constraint or undue influence.

Witnesses

On the date above-written, Dayton Rohan and Adelia Harber, known to us to be the persons whose signatures appear at the end of this Will, declared to us, the undersigned, that the foregoing instrument is their Joint Last Will and Testament. They then signed the document in our presence, and we, at their request, and in their presence, and in the presence of each other, have subscribed our names as witnesses.
