I. Scope of Services

The Photographer will provide a full range of professional photography services to capture these moments in their entirety. This duration includes the full performance and possible pre-event activities such as sound checks or VIP meet-and-greets. The Photographer will arrive at the venue at least one hour before the scheduled start time to set up the necessary equipment and prepare for the shoot. The agreed-upon hours of coverage, which may include setup and wrap-up time, will be from [5:00 PM] to [11:00 PM].

The Photographer will also provide a 2-minute highlight reel, which will feature the best moments from the event, including key performances, crowd reactions, and any notable behind-the-scenes footage. This video will be designed for social media use, promotional purposes, or personal memories.

  2. Coverage Area:

    The Photographer will provide coverage in multiple key areas of the event, ensuring a comprehensive visual representation. These areas will include:

    • Performance Shots: Capturing live performances, including close-ups of the performers, wide-angle shots of the band on stage, and moments of high-energy crowd engagement.

    • Behind-the-Scenes: Documenting the preparations, sound checks, and backstage moments. This includes candid shots of performers, crew, and other personnel involved in the event.

    • Audience Reactions: Capturing the audience’s emotional response to the performances, such as dancing, singing along, and expressions of joy or excitement.

    • VIP and Special Guest Moments: Any interactions between special guests, VIPs, and performers that contribute to the overall experience of the event.

  3. Editing Services:

    After the event, the Photographer will perform post-production editing on all photographs. This includes:

    • Basic Retouching: Removing minor imperfections such as glare, shadows, or distracting elements in the frame. The Photographer will ensure that the final images maintain a natural and high-quality appearance.

    • File Optimization: All final images will be optimized for web use and printing, ensuring that each photograph is in the proper resolution for its intended use.

II. Payment Terms

A. Service Fee

  1. Total Cost:

    The total fee for the Photographer’s services is [$5,000]. This price includes coverage of the event, post-production services, and the delivery of a specified number of high-resolution images and videos. The total cost is broken down as follows:

B. Additional Costs

III. Client Responsibilities

A. Venue and Access

  2. On-Site Contact:

B. Permissions and Authorizations

  1. The Client is responsible for obtaining any necessary permissions or releases from third parties, including:

    • Performers: Securing the consent of performers, speakers, or any other individuals whose likenesses may be used in the photographs or video footage.

    • Venue: Ensuring that the Photographer is allowed to use professional camera equipment and shoot in all necessary areas of the venue.

    • Event Sponsors: If applicable, obtaining permission to capture branded content and marketing materials displayed at the event.

  2. Non-Liability for Delays:

    The Photographer will not be held responsible for any delays, cancellations, or limitations in photography services caused by the lack of required permissions, including failure to secure access to key areas of the venue or performer consent.

IV. Photographer's Responsibilities

A. Equipment

  1. The Photographer will bring professional-grade equipment to capture the event, including but not limited to:

    • Cameras: High-quality DSLR or mirrorless cameras with backup options in case of failure.

    • Lenses: A selection of lenses suitable for wide-angle shots, close-up portraits, and low-light performance photography.

    • Lighting: Flash units and continuous lighting to enhance the visual quality in darker settings or areas with poor natural lighting.

  2. Backup Equipment:

    To prevent any interruptions, the Photographer will bring backup equipment, including additional memory cards, batteries, and lenses.

B. Professional Conduct

  1. The Photographer will:

    • Arrive at the venue at least [1 hour] before the event’s scheduled start time. This will allow time for setup, testing equipment, and preparing for the event.

    • Maintain a professional demeanor throughout the event, interacting courteously with staff, performers, and attendees. The Photographer will ensure they do not disrupt the event or the audience’s experience while capturing the necessary moments.

  2. Image Backup:

    All photographs will be backed up on multiple storage devices to prevent data loss. The Photographer will retain a copy of the event photos for a period of [30] days from the event date, after which the photos will be deleted unless the Client requests extended storage.

V. Delivery of Final Products

A. Delivery Timeline

  1. Images:

    • High-resolution images will be delivered via a secure online gallery, which will allow the Client to view, download, and share the final images. The gallery will be accessible within [14] days of the event. The Client will receive an email notification with the link to the gallery once the images are ready.

    • Each image will be watermarked for protection during the initial viewing period. Once the final payment has been made, the watermark will be removed from the downloadable versions.

  2. Highlight Video:

    The Photographer will also provide a [2-minute] highlight video that features the best moments of the event. This video will be delivered to the Client within [21] days after the event. B. Revisions

    If the Photographer must cancel the event due to unforeseen circumstances, such as illness or an emergency, the Client will receive a full refund of any payments made, including the deposit. The Photographer will make every effort to assist the Client in finding a suitable replacement photographer if necessary.

B. Rescheduling Policy

  1. Event Rescheduling:

    • If the event is rescheduled, the Photographer will work with the Client to accommodate the new date. The Client is required to provide notice of the rescheduled date as soon as possible to allow time for adjustments.

    • A rescheduling fee of [$100] may apply if the new date causes significant changes to the Photographer’s schedule, such as conflicting bookings.

VII. Liability and Insurance

A. Limitations of Liability

In such cases, the Photographer will work with the Client to reschedule the event coverage or make alternative arrangements if possible.

B. Insurance Coverage

    The Photographer maintains a professional liability insurance policy with coverage up to [$1,000,000]. This insurance covers potential legal claims related to negligence, equipment damage, or other professional risks. The Client is encouraged to maintain their own event insurance, particularly if there are concerns about liability for property damage or injuries during the event.

VIII. Copyright and Usage Rights

A. Ownership

    The Photographer retains full ownership and copyright over all photographs and video footage created under this Agreement. This means that the Photographer has the right to use, sell, license, or distribute the images as they see fit.

B. Client Usage Rights

  1. Non-Exclusive License:

    The Client is granted a non-exclusive, perpetual license to use the photographs and videos for promotional, personal, or business purposes. These uses may include marketing, advertisements, social media, websites, and print materials. The Client will have full rights to display the images within their own promotional campaigns, with attribution to the Photographer if required.

  2. Restrictions on Commercial Use:

    The Client is not authorized to resell, distribute, or license the images for commercial gain without obtaining written permission from the Photographer. This includes using the images in any product that will be sold to the public or licensing the images to third parties.

IX. Miscellaneous Provisions

A. Governing Law

  1. Jurisdiction:
