Sample Settlement Agreement
This Settlement Agreement (the "Agreement") is made and entered into as of this 16th day of August, 2066 by and between the following parties:
Parties
Plaintiff: [Your Name], residing at [Your Address].
Defendant: Dexter Dicken residing at Boise, ID 83701.
Purpose
The purpose of this Agreement is to resolve and settle any and all disputes, claims, or controversies between the Plaintiff and the Defendant (collectively, the "Parties") in connection with the breach of contract related to the supply of goods under the agreement dated June 15, 2066. This Agreement sets forth the terms and conditions agreed upon by the Parties to fully and finally resolve their disputes.
Terms and Conditions
1. Settlement Payment
The Defendant agrees to pay the Plaintiff a settlement amount of $755,000 (the "Settlement Amount"). The Settlement Amount shall be paid in full by September 2, 2066 through bank transfer.
2. Release and Discharge
Upon receipt of the Settlement Amount, the Plaintiff hereby releases and discharges the Defendant from any and all claims, demands, actions, or causes of action, in law or equity, which the Plaintiff may have against the Defendant, whether known or unknown, arising out of or connected with the aforementioned matter.
3. Confidentiality
Both Parties agree to keep the terms of this Agreement confidential and not to disclose any information regarding this Agreement to any third party, except as required by law or necessary to enforce the terms of this Agreement.
4. No Admission of Liability
It is expressly understood and agreed that this settlement is made as a compromise of disputed claims and is not to be construed as an admission of liability by the Defendant, who expressly denies any liability.
5. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of [State], without regard to its conflict of laws provisions.
6. Entire Agreement
This Agreement constitutes the entire agreement between the Parties with respect to the subject matter hereof and supersedes all prior and contemporaneous agreements, understandings, and negotiations, whether written or oral, between the Parties.
7. Severability
If any provision of this Agreement is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of this Agreement, which shall remain in full force and effect.
