RECITALS
WHEREAS, the Landlord and Tenant have entered into a Lease Agreement ("Lease") dated December 1, 2049, for the rental property located at 456 Maple Street, Springfield, IL 62701; and
WHEREAS, Tenant and Landlord desire to waive certain rights and responsibilities as set forth below.
NOW, THEREFORE, for good and valuable consideration, the parties agree as follows:
1. Waiver of Claims
The Tenant acknowledges and agrees to waive any claims, damages, or actions against the Landlord arising from the following conditions:
a. Minor cosmetic issues in the apartment, including scratches on the walls, dents in the door, and wear and tear on flooring.
b. Delays in repair of non-essential fixtures, such as light bulbs in common areas or minor appliance malfunctions, unless such delays exceed 30 days.
2. Limited Liability of Landlord
The Landlord will not be held liable for any damages or loss incurred by the Tenant due to:
a. Failure to repair minor plumbing issues (e.g., slow-draining sink or faucet leaks) that do not affect the habitability of the premises.
b. Any temporary inconvenience caused by maintenance, cleaning, or landscaping activities. The Landlord agrees to provide a 24-hour notice before major work is done.
3. Indemnification
Tenant agrees to indemnify and hold harmless the Landlord from any claims, damages, or lawsuits arising out of or in connection with:
a. Tenant's failure to follow safety protocols or instructions regarding the use of property, such as improper disposal of waste or misuse of appliances.
b. Any unauthorized modifications made to the property by the Tenant, including but not limited to, painting the walls or installing shelves without prior written consent from the Landlord.
4. Governing Law
This Agreement shall be governed by and construed by the laws of the state of Illinois.
5. Entire Agreement
This Agreement represents the entire understanding between the parties concerning the waiver of liabilities and supersedes all prior negotiations, representations, and agreements, whether written or oral, between the parties concerning the subject matter hereof.
6. Execution
This Agreement is executed by the undersigned parties as of the date first written above.
