If the Student is late for a lesson, the School reserves the right to shorten the lesson by the time lost due to the delay. The Student must notify the School at least [00] days in advance if they are unable to attend a lesson.
B. Preparation
The Student is expected to come prepared for each lesson, which includes having a valid learner's permit or driver’s license, appropriate clothing, and any materials requested by the instructor. The Student must also ensure they are physically capable of driving and not under the influence of alcohol, drugs, or other impairing substances.
C. Behavior and Conduct
The Student agrees to behave respectfully toward the instructor and adhere to all traffic laws during lessons. Any disruptive or dangerous behavior may result in immediate termination of the lesson, and the Student may be liable for the cost of the session. The School reserves the right to dismiss the Student from further lessons if such behavior continues.
D. Responsibility for the Vehicle
If the Student uses their own vehicle for lessons, they must ensure that it is in safe, roadworthy condition, and meets all legal requirements, including insurance. The School is not responsible for any damage to the Student’s vehicle during lessons, unless caused by the instructor’s negligence. The Student must also ensure that the vehicle is insured for use during driving instruction.
V. Instructor’s Responsibilities
A. Provision of Instruction
The School is responsible for providing professional driving instruction, following state regulations and industry best practices. Instructors will provide feedback and support throughout the course to help the Student improve their driving skills. Lessons will be conducted in a safe and controlled environment to ensure the Student’s safety.
B. Safety and Legal Compliance
The School will ensure that all lessons are conducted in compliance with applicable laws and regulations. Instructors will follow safety protocols to minimize risks to both the Student and other road users. The School will provide a properly maintained vehicle for driving lessons if necessary.
C. Equipment and Materials
The School will provide all necessary equipment for lessons, including instructional materials, safety equipment, and a vehicle (if applicable). The Student may be required to purchase additional materials, such as study guides or textbooks, at their own expense.
VI. Liability and Insurance
A. Liability Waiver
The Student acknowledges and understands that learning to drive involves inherent risks, including the potential for accidents, injury, or property damage. By signing this contract, the Student agrees to waive any claims against the School, its instructors, and its employees, except in the case of instructor negligence or intentional misconduct. The Student further agrees to be responsible for their actions during lessons and to follow all safety instructions provided by the instructor to minimize risk.
B. Insurance Coverage
The School provides liability insurance that covers third-party damages in the event of an accident involving a School-owned vehicle during lessons. However, the Student is responsible for ensuring that their own personal vehicle, if used for lessons, is fully insured and meets the legal requirements for road use. In the event of any incident or accident, the Student must inform the School immediately, and any claims related to damage to their own vehicle will be their responsibility.
C. Accident or Injury
In the event of an accident or injury during a driving lesson, the Student agrees to immediately report the incident to both the School and relevant authorities. The Student will be required to cooperate fully with insurance providers and law enforcement as necessary to resolve the situation. The School will take all reasonable precautions to minimize accidents, but the Student acknowledges that the risk of such incidents cannot be entirely eliminated.
VII. Completion Requirements
A. Course Completion Criteria
The Student is required to attend a minimum of [00] lessons and demonstrate sufficient proficiency in both theoretical knowledge and practical driving skills to complete the course successfully. The School may require the Student to complete supplementary lessons if they do not meet the necessary skill level by the end of the course. B. Certification of Completion
Upon the Student's successful completion of all course requirements, including passing the final driving test and demonstrating a competent understanding of road safety, the School will issue a Certificate of Completion. This certificate may be used by the Student to apply for their full driving license, subject to the requirements of their local Department of Motor Vehicles (DMV). However, the School does not guarantee that the Student will pass the official driving test, as it is ultimately dependent on the Student’s performance.
VIII. Cancellation, Termination, and Breach
A. Cancellation by the Student
The Student may cancel this contract within [00] days of signing without incurring additional charges, provided no lessons have been attended. If the Student has already attended one or more lessons, cancellation will be subject to the School's refund and cancellation policy, and any lessons taken will be deducted from the total fee. Cancellation requests must be submitted in writing to the School at [Your Company Email], and the Student will receive a confirmation of cancellation once processed.
B. Cancellation by the School
The School reserves the right to cancel this contract if the Student fails to make timely payments or engages in behavior that compromises the safety and well-being of themselves, the instructor, or others on the road. In cases of cancellation due to non-payment or misconduct, the School will issue no refunds for lessons already provided. The School will notify the Student of the cancellation in writing, and any lessons not yet attended will be forfeited without reimbursement.
C. Breach of Contract
A breach of contract occurs when either party fails to fulfill their obligations as outlined in this agreement, including but not limited to non-payment, non-attendance, or failure to follow the terms of the agreement. If a breach occurs, the non-breaching party may terminate the contract and seek damages if applicable. The Student will be responsible for paying for all lessons completed up until the breach, and any outstanding balances must be settled promptly.
IX. Miscellaneous Provisions
A. Governing Law
This contract will be governed by and construed in accordance with the laws of the state of [State], without regard to its conflict of laws principles. Any legal proceedings arising out of or related to this contract must be brought in the courts of [State], and both parties consent to the jurisdiction of those courts. The parties also agree that, if any dispute arises, the laws of [State] will govern the interpretation and enforcement of the agreement.

C. Severability
If any provision of this contract is determined to be invalid or unenforceable by a court of competent jurisdiction, the remainder of the contract will remain in full force and effect. The invalid or unenforceable provision will be modified to the extent necessary to make it enforceable, while preserving the original intent of the contract. This ensures that the enforceability of the contract as a whole is not affected by any one provision.
D. Dispute Resolution
In the event of a dispute between the parties, the parties agree to first attempt to resolve the issue through informal discussions. If the dispute cannot be resolved through informal means, the parties agree to attempt mediation before pursuing arbitration or legal action.
