Introduction

  • Setting performance goals for the next quarter: Clear goals and expectations for the upcoming quarter will be established during the review.

5.3. Communication of Results

Performance data and results will be communicated to the Employee by email within 10 business days of the quarterly review, ensuring timely feedback and transparency.

Dispute Resolution

6.1. Resolution Process

In the unlikely event of a dispute regarding performance evaluations or bonus calculations, the parties will follow the dispute resolution process outlined in Appendix B, which includes the following steps:

  • Initial discussion: The parties will engage in open dialogue to attempt to resolve the dispute amicably.

  • Mediation: If the initial discussion does not lead to a resolution, a neutral third-party mediator will be engaged to facilitate negotiations.

  • Arbitration: If mediation proves unsuccessful, the dispute will be referred to binding arbitration for a final decision.

Termination of Agreement

7.1. Termination Conditions

This SLA may be terminated under specific circumstances, including but not limited to:

  • Breach of confidentiality: Any breach of the confidentiality agreement outlined in Appendix D.

  • Violation of ethical standards: Any violation of ethical or professional standards deemed unacceptable by the Company.

  • Termination of employment: The Employee's employment with the Company comes to an end.

Termination of this SLA may affect Employee's eligibility for a performance bonus as detailed in Appendix C. It is essential to understand that termination of the SLA might result in the forfeiture of bonus entitlements, depending on the circumstances leading to termination.

8.1. Commitment to Confidentiality

Both parties, the Company and Employee, are bound by a shared commitment to maintain the utmost confidentiality regarding performance data and bonus information, as meticulously outlined in the comprehensive confidentiality agreement provided in Appendix D.
