Artist Management Contract
This Agreement is entered into this [Date], by and between [Your Name], (hereinafter "Artist"), residing at [Your Address], and [Manager's Name) (hereinafter "Manager"), located at [Manager Address].
1. SCOPE OF REPRESENTATION
The Manager promises to render such advice, guidance, and other services as the Artist may require in the furtherance of the Artist's career in the music industry, including but not limited to, procurement of employment, negotiation of contracts, career development, and promotion.
2. TERM
The term of this Agreement will commence upon [Date] and will continue for a period of [Number of Years] unless otherwise terminated by either party by this Agreement.
3. COMPENSATION
In return for the services rendered by the Manager, compensation will be provided to the Manager. This remuneration will either be a fixed percentage, specified as a Percentage (%), of the total gross earnings accrued by the Artist or it could be a predetermined flat fee stated as Amount in a specified currency.
4. RESPONSIBILITIES OF BOTH PARTIES
By this Agreement, each party is making a declaration of commitment to fulfill their responsibilities as outlined herein. The Artist pledges to engage in their respective tasks, primarily focused on art production and creation, exhibiting a high standard of professionalism and dedication. On the other hand, the Manager promises to bring forth their expertise, encompassing a broad spectrum of services in management and promotion, utilizing their skills to the fullest in all relevant arenas.
5. RIGHTS AND OWNERSHIP
The Artist shall retain all rights and ownership pertaining not only to their work and recordings but also to their intellectual property and all other materials. All of these assets shall continue to remain under the sole ownership of the Artist.
6. TERMINATION
If either party involved wishes to terminate this Agreement, they are fully within their rights to do so. However, they must adhere to the stipulated Notice Period, which requires them to forward written notification at least [Notice Period] days before the intended termination. It should be noted that this written notice not only has to specify the exact reason behind such termination but also any remuneration that may be due upon the termination. This remuneration must also be clearly stated in the termination notice if there are any due amounts.
7. DISPUTE RESOLUTION
Should there arise any disagreements or conflicts that pertain to this Agreement, both parties agree to engage and resolve such disputes through a process of mutual dialogue, negotiation, and discussion. In instances when this agreed-upon process lacks the requisite efficacy to resolve the disputes, both parties commit to resorting to a mediation or arbitration process that both parties have consented to, if and when it becomes necessary.
8. CONFIDENTIALITY
Both parties involved in the Agreement have come to a consensus to handle with care any confidential information of the other party's business, plans, and customers that they manage to obtain during this Agreement. The information being referred to here is anything that isn't openly available to the public.
9. REPRESENTATION AUTHORITY
By the terms and responsibilities outlined in this Agreement, the Manager only possesses the authority to represent the Artist. Further, this authorization to represent is bound within the directions provided specifically by the Artist. Any representation outside of these confines is beyond the Manager's authority.
10. GOVERNING LAW
This Agreement shall be governed by and construed by the laws of [Governing Jurisdiction].
