This Contract outlines the terms and conditions for animal care services, including responsibilities, liabilities, fees, and other provisions necessary for the safe, ethical, and effective care of animals.

I. Definitions and Scope of Service

The term "Client" may also refer to representatives authorized by the Client to make decisions regarding the care of the pet(s). It is essential that all details about the Client’s identity, contact information, and any specific needs of the pet(s) be provided accurately in order to ensure the best possible care.

  2. Service Provider
[Your Company Name], which provides professional animal care services to the Client as outlined in this contract. The Service Provider is responsible for ensuring the safety, well-being, and comfort of the pet(s) while in its care and for delivering services as per the mutually agreed-upon terms.

  3. Animal Care Services
A range of activities designed to maintain the health, well-being, and comfort of pets under the Client's care. These services may include basic needs like feeding, grooming, and exercise, as well as more specialized services such as medical administration, behavioral training, and emergency medical care. Services will be provided as agreed in this Contract or as requested and approved by the Client.

  4. Pet
The term "Pet" refers to any domestic animal under the ownership or guardianship of the Client. This includes, but is not limited to, common pets such as dogs, cats, birds, reptiles, and small mammals. The specific type, breed, age, and health status of each pet should be documented and disclosed by the Client to the Service Provider to ensure the highest level of care.

B. Scope of Service

  1. Basic Services
[Your Company Name] agrees to provide a suite of essential animal care services, including but not limited to:

II. Responsibilities and Duties of the Parties

A. Responsibilities of the Service Provider

  1. Safety and Care Standards
[Your Company Name] is committed to the safety and well-being of all pets under its care. The Service Provider will adhere to industry best practices and established animal care standards. 2. Animal Welfare
The health and welfare of the pet(s) are of utmost importance. The Service Provider will ensure that all animals receive adequate food, water, shelter, and social interaction to promote their physical and emotional well-being. The Service Provider shall also maintain a clean and safe environment for the pets, free of any hazards that could cause harm.

  3. Record-Keeping
Comprehensive records will be maintained for each pet in care. These records will include feeding schedules, medication administration logs, behavioral notes, grooming reports, and any observations related to the pet’s health or well-being. This information will be stored securely, and the Client will have access to these records upon request.

  4. Emergency Procedures
In the event of a health or safety emergency, the Service Provider will take immediate action to ensure the pet’s well-being. This may include administering first aid, contacting a veterinarian, or seeking medical attention from an emergency animal care facility. Every effort will be made to notify the Client immediately, and the Client agrees to provide authorization for any emergency treatment.

  2. Access and Supplies

V. Termination and Cancellation

A. Termination by Client

The Client may terminate this agreement at any time with written notice to [Your Company Name]. It is the responsibility of the Client to inform [Your Company Name] of the decision to terminate the Contract at least [7] days before the intended date of termination. This notice should be submitted through official communication channels, either by email or certified mail, to ensure proper documentation. In the event of termination, the Client will remain liable for any services rendered prior to the termination date. If services have been provided for a portion of the month, the Client is obligated to pay for the services rendered up until the termination date, and no refunds for services rendered will be issued. Should the Client terminate this agreement without providing sufficient notice, the Service Provider reserves the right to charge a penalty equal to the service fee for the remaining portion of the notice period.

Furthermore, if termination occurs before the completion of an agreed service period (such as a series of training sessions or specialized grooming), the Client will be charged for the portion of services provided, and the Client may be subject to additional cancellation fees as detailed in the fee structure.

B. Termination by [Your Company Name]

[Your Company Name] reserves the right to terminate this agreement at any time, with or without cause, if it determines that the continuation of the service relationship is not in the best interests of the pet(s), the Client, or the company itself. Such reasons for termination include, but are not limited to:

  • Non-payment or failure to meet financial obligations as outlined in Section IV, including overdue invoices or consistently late payments.

  • Providing false or misleading information about the pet, its health, or behavioral history.

  • If the pet is found to be a danger to the health or safety of other animals, staff, or people, including aggressive behavior or severe medical conditions that prevent proper care.

  • A breach of this contract's terms by the Client, including failure to adhere to the policies and procedures outlined in this document.

In the event that [Your Company Name] terminates the agreement, written notice will be provided to the Client, outlining the reason for the termination. Termination can occur immediately, or with [7] days’ notice, depending on the nature of the situation. The Client will remain liable for any outstanding payments for services rendered prior to termination. If the termination is due to non-payment or breach of contract by the Client, no refund will be issued for any advance payments, and the Client will be required to settle any outstanding debts.

VI. Liability and Insurance

A. Liability of Service Provider

[Your Company Name] will take all necessary precautions to ensure the safety and well-being of the pet(s) under its care. The Service Provider staff will use reasonable care, skill, and attention while providing services to the pet(s). However, the Client acknowledges and agrees that [Your Company Name] will not be held liable for any injury, illness, or harm that occurs as a result of circumstances beyond its control, including, but not limited to, accidents, natural disasters, or unforeseen medical conditions.

While in the care of [Your Company Name], pets are protected from hazards and accidents as much as possible. The Service Provider takes responsibility for any injuries or illnesses that result from the direct actions of its employees, such as failure to properly follow instructions or mishandling of the pet during care. However, if the injury, illness, or behavior change is due to factors not attributable to the Service Provider, such as pre-existing health conditions, behavioral problems, or external accidents (such as a pet running away or being injured by another animal), the Service Provider shall not be held responsible.

B. Insurance Coverage

[Your Company Name] carries general liability insurance and professional indemnity insurance to cover injuries and damages that may occur while the pet is in our care, provided these incidents result directly from negligence or error on the part of the Service Provider. However, the Service Provider’s liability insurance is not intended to cover the pet’s health or medical treatment costs in the event of an injury or illness, nor does it cover losses arising from events outside the scope of service provided (for example, theft or third-party accidents).

The Service Provider recommends that the Client maintain their own pet insurance policy to ensure that any unforeseen medical costs or damage to the pet are covered. If a situation arises that requires veterinary treatment beyond the Service Provider’s scope, the Client will be responsible for the cost of veterinary care. [Your Company Name] will make reasonable efforts to notify the Client in such cases, and the Client authorizes the Service Provider to seek emergency medical attention if needed.

VII. Confidentiality and Data Protection

A. Confidentiality

Both parties agree to maintain the confidentiality of all proprietary and personal information shared during the term of this contract. This includes information about the Client, the Client’s pets, personal contact details, medical histories, and any other confidential material provided. The Service Provider will ensure that all such information is stored securely and used solely for the purpose of fulfilling the obligations set forth in this Contract. Information will not be disclosed to any third party unless:

  • The disclosure is required by law (e.g., for reporting suspected animal cruelty or in response to a legal subpoena).

  • The Client provides explicit consent for disclosure (e.g., for sharing pet medical history with a veterinarian).

  • The disclosure is necessary for the provision of services (e.g., sharing information with veterinary care professionals if the pet requires emergency treatment).

The Service Provider will not use or share the Client’s or pet’s personal data for any purpose unrelated to animal care services, unless explicit consent is obtained from the Client in writing. All data handling will be in accordance with applicable data protection regulations.

B. Data Protection

[Your Company Name] is committed to maintaining the highest standards of data protection in compliance with relevant privacy laws, including the Data Protection Act 2025 and any applicable laws in the jurisdiction in which the Service Provider operates. Personal data, including the Client's contact details, payment information, and pet health records, will be securely stored and managed with respect to confidentiality.

The Client has the right to request access to their data and correct any inaccuracies or incomplete information. In the case of termination of the Contract, the Client’s data will be securely deleted or anonymized, except in cases where retention of the data is required for legal or business purposes. The Client agrees that [Your Company Name] may retain certain information related to pet care services for legal, regulatory, or operational purposes, such as audit trails or compliance with tax obligations.

VIII. Dispute Resolution

A. Informal Dispute Resolution

In the event of any disagreement or dispute arising from this Contract, both the Service Provider and the Client agree to first seek to resolve the issue through informal negotiations. This includes communication between both parties to fully understand the nature of the dispute and attempt to find a reasonable and mutually agreeable solution. If the issue can be resolved through direct communication and adjustment of services or terms, both parties will aim to reach a settlement that works for everyone involved.

B. Mediation and Arbitration

If informal negotiation fails to resolve the dispute, both parties agree to proceed with formal dispute resolution methods, including mediation and, if necessary, arbitration. Mediation will be conducted by a third-party mediator experienced in contractual disputes, and both parties will share the costs of mediation equally. If mediation does not result in a satisfactory resolution, arbitration may be pursued, and the decision made by the arbitrator will be binding.

Arbitration will be conducted in accordance with the Arbitration Act 2035, and the location for such arbitration will be determined by mutual agreement of the parties. The costs of arbitration, including the arbitrator's fees, will be borne by the losing party, as determined by the arbitrator. Both parties agree to abide by the results of the arbitration process.

C. Jurisdiction and Venue

This Contract and any disputes arising from or related to it shall be governed by the laws of the state in which [Your Company Name] is located, regardless of the Client's location. Any legal action or proceeding arising out of or related to this Contract shall be exclusively brought in the courts of the jurisdiction where [Your Company Name] is based, and both parties consent to the exclusive jurisdiction and venue of such courts.

IX. Governing Law

This Contract is governed by the laws of the State in which [Your Company Name] is located, without regard to its conflict of law principles. Both parties agree that any legal proceedings related to this Contract will be subject to the jurisdiction of the state courts in [Your State], and each party submits to the exclusive jurisdiction of these courts.

If any part of this Contract is deemed unenforceable, the remaining sections shall remain in full force and effect. The parties further agree that any amendments or modifications to this Contract must be made in writing and signed by both parties to be legally binding.
