Gym Membership Agreement

This Gym Membership Agreement ("Agreement") is entered into by and between [Your Company Name], hereinafter referred to as "Gym," and the undersigned individual, hereinafter referred to as "Member." By signing this Agreement, the Member agrees to be bound by the following terms and conditions.

1. Membership Terms

1.1 Eligibility: Membership is available to individuals 18 years of age and older. Minors aged 14 to 17 may be eligible for membership with written consent from a parent or legal guardian.

1.2 Membership Types: The Gym offers various membership plans, including but not limited to monthly, yearly, family, and corporate memberships. Details of each plan, including benefits and fees, are available at the Gym's reception and website.

1.3 Membership Term: Memberships are available on a monthly or annual basis. The term of the membership will commence on the date of this Agreement and will automatically renew unless terminated in accordance with Section 5.

2. Membership Fees and Payment

2.1 Fee Structure: Membership fees are detailed in the membership plan selected by the Member. These fees may include initiation fees, monthly or annual dues, and additional charges for specific services or amenities.

2.2 Payment Method: Members agree to provide a valid credit or debit card for automatic billing of membership fees. Payments may also be made by cash or check at the Gym’s discretion.

2.3 Payment Schedule: Membership fees are due in advance on the first day of each billing cycle. If a payment is declined or fails, the Member will be notified and must provide an alternative payment method within [7] days to avoid suspension of membership privileges.

2.4 Fee Changes: The Gym reserves the right to change membership fees upon 30 days' written notice to Members. Changes will not affect pre-paid memberships until the end of the current term.

3. Member Responsibilities and Conduct

3.1 Compliance: Members agree to comply with all Gym policies, rules, and regulations, which may be amended from time to time. These policies are designed to ensure a safe and enjoyable environment for all members.

3.2 Behavior: Members are expected to conduct themselves in a respectful manner. Abusive, disruptive, or inappropriate behavior will not be tolerated and may result in immediate termination of membership without a refund.

3.3 Use of Facilities: Members must use equipment and facilities responsibly and follow all posted instructions and guidelines. Any damage caused by misuse of equipment will be the responsibility of the Member.

3.4 Health and Safety: Members must certify that they are in good health and have no medical conditions that would prevent safe participation in Gym activities. Members should consult their physician before starting any exercise program.

4. Gym Rights and Responsibilities

4.1 Hours of Operation: The Gym’s hours of operation are posted at the facility and on the website. The Gym reserves the right to modify these hours as necessary, including for holidays, special events, or maintenance.

4.2 Facility Maintenance: The Gym will make reasonable efforts to maintain the facility and equipment in good working order. However, temporary closures may occur for repairs, maintenance, or upgrades.

4.3 Personal Training and Classes: The Gym offers personal training and group classes for an additional fee. Scheduling and fees for these services are available at the reception desk.

4.4 Member Privacy: The Gym respects the privacy of its members and will handle personal information in accordance with applicable privacy laws. The Gym will not disclose personal information to third parties without consent, except as required by law.

5. Termination and Suspension

5.1 Termination by Member: Members may terminate their membership at any time by providing written notice to the Gym. Termination will be effective at the end of the current billing cycle, and no refunds will be provided for unused portions of the membership term.

5.2 Termination by Gym: The Gym reserves the right to terminate membership for violation of this Agreement, non-payment of fees, or conduct detrimental to the Gym or its members. In such cases, no refunds will be provided.

5.3 Suspension: Membership may be temporarily suspended for medical reasons or extended travel upon written request. Suspensions must be for a minimum of one month and a maximum of six months.

6. Assumption of Risk and Release of Liability

6.1 Assumption of Risk: The Member acknowledges that participation in physical activities and use of gym equipment involves inherent risks, including but not limited to injury, illness, or death. The Member voluntarily assumes all risks associated with their participation.

6.2 Release of Liability: To the fullest extent permitted by law, the Member releases the Gym, its owners, employees, agents, and contractors from any and all claims, liabilities, or damages arising out of or in connection with the Member's use of the Gym’s facilities and participation in Gym activities.

6.3 Indemnification: The Member agrees to indemnify and hold harmless the Gym from any and all claims, damages, or expenses arising out of the Member's breach of this Agreement or negligent actions.

7. Miscellaneous Provisions

7.1 Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the state in which the Gym is located.

7.2 Dispute Resolution: Any disputes arising out of or in connection with this Agreement shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

7.3 Severability: If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

7.4 Entire Agreement: This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements, representations, or understandings, whether written or oral.

7.5 Amendments: This Agreement may only be amended by a written document signed by both the Member and an authorized representative of the Gym.

7.6 Waiver: The failure of either party to enforce any right or provision of this Agreement shall not constitute a waiver of that right or provision.
